I’ve always been an outdoors person, and I love going hiking and exploring in Southern California’s beautiful wild lands, mountains, and deserts.  Long before I entered politics, I served as a volunteer Ranger with the Orange County Park Ranger Reserve.  This past week, I had the pleasure of talking with Irvine Ranch Conservancy Executive Director Michael O’Connell last week during a ZOOM meeting Town Hall.

Based in Orange County, California, the mission of the IRC is to ensure the protection, restoration and enhancement of the natural resources of the Irvine Ranch Natural Landmarks forever and to provide diverse opportunities for public participation by conducting and supporting scientific, recreational and educational initiatives and programs.

Michael O’Connell, Irvine Ranch Conservancy President and Executive Director, oversees all aspects of stewardship, public programs and business operations for the Irvine Ranch Conservancy. He has 25 years experience in land protection and conservation science including senior positions with The Nature Conservancy and World Wildlife Fund. He has served on the Board of Governors of the Society for Conservation Biology, and the Advisory Board of the Bren School of Environmental Science and Management at UC Santa Barbara. He is currently on the Dean’s Leadership Council for the School of Biological Sciences at UC Irvine. Michael has co-authored two books on conservation and a number of scientific and popular articles. He has a bachelor’s degree in Geology from Carleton College and a Master’s in Conservation Biology from Yale School of Forestry and Environmental Studies.

After we talk about the history and the special character of this incredible land, Mike leads us on a tour of this incredible natural resource in our backyard.

“ReOpen OC Safely” — Orange County Business Council Posts Guidelines for Safely Reopening Orange County Businesses

The Orange County Business Council (OCBC) has developed and published a set of guidelines called “ReOpen OC Safely: Requirements and Best Pratices for Reopening Your Business Safely and Within Current Guidelines” for safely reopening Orange County businesses as the county continues to respond to the COVID-19 crisis. 

ReOpen OC Safely was developed in collaboration with Greater Irvine Chamber of Commerce, North Orange County Chamber of Commerce, Anaheim Chamber of Commerce, Santa Ana Chamber of Commerce, and Visit Anaheim as a resource to prepare to safely reopen for business as the county continues to respond to the COVID-19 crisis. 

The State of California has issued “stay at home” emergency orders, but is slowly reopening business segments, subject to restrictions, with modified operations, click here to learn more.

The OCBC guidelines are intended to conform to the restrictions and recommendations of both the State of California and the federal government regarding COVID-19.

Regardless of your industry sector, OCBC recommends that businesses begin planning to reopen, consider guidelines of the Center for Disease Control (CDC), state, county and local guidelines (which may be more restrictive), and plan to ensure the safety and well-being of employees, customers and all those interacting with your business. Note: many draft guidelines will be changed as new information is obtained. Stay engaged. Some general guidelines for developing your plan may include:

  1. Social Distancing : Develop a plan that enables social distancing with current CDC guidance in mind. When possible, practice social distancing by staying at least 6 feet apart from others, particularly for prolonged periods of 10 minutes or more. Develop a plan to manage customer density in queues, restaurants, retail environments or other business facilities.
  1. Cleanliness and Sanitation: Develop a plan that provides enhanced cleaning procedures including establishing frequency, products, and methods on all high touch areas.
  1. Screening and Prevention: Develop a plan that incorporates government/medical recommended screening procedures and preventative measures including personal protective equipment (masks or gloves). 
  1. Transactions: Develop and implement a plan to expedite transactions and where possible incorporate technology like online/mobile order pick up or touch-less transactions.
  1. Employee Training and Tools: Develop a plan that includes training for employees regarding  procedure and expectation changes related to COVID-19

The OCBC guidelines also include specific guidance for individual sectors of the economy, including manufacturing, healthcare, transportation and logistics, professional and business services, global trade, utilities, construction, hospitality and tourism, retail, child care, communications infrastructure, hotels and lodging, life sciences, real estate, theme parks, convention centers, delivery services, agriculture and livestock, food packaging, public transportation, restaurants, and shopping centers.

The OCBC provides links to a checklist for what to do when an employee tests positive for COVID-19, as well as a link to a survey of California businesses regarding re-opening issues.

There are also links to many helpful resources from state, county, and federal agencies.

I strongly recommend that all businesses (and business patrons) in Orange County become familiar with these guidelines, and that they be followed in order to prevent a spike in COVID-19 infections as Orange County businesses begin to re-open to the public.

I have also decided to use my Assembly campaign phone-banking and community outreach resources to call seniors and people in need of critical services in the cities of Assembly District 68 — Lake Forest, Tustin, Orange, Irvine, Anaheim Hills and Villa Park — to ask how they’re doing during this stressful time and to see whether they need any help, including food assistance and mental health assistance and other community resources.  Our volunteer callers will be able to provide information and connect seniors with any community assistance or resources they might need. Read the story in the O.C. The People Have Spoken: The Irvine City Council Should Designate the ARDA as the Site for the Orange County Veterans Cemetery. UPDATED!

UPDATE[May 13, 2020] At last night’s Irvine City Council meeting, the Council voted 4-1 to agree with me and to adopt the citizens’ initiative calling for locating a state veterans cemetery at the originally designated ARDA site adjacent to the Great Park on the ground of the former El Toro Marine Corps Air Station (MCAS El Toro).  The ARDA is located in the 68th Assembly District.  As the Assemblymember for the 68th Assembly District, I will work to ensure that the state fulfills its promise to “acquire, study, design, develop, construct, and equip a state-owned and state-operated Southern California Veterans Cemetery” on the hallowed grounds of the former El Toro Marine Base.

The time has come to settle the issue of where to locate a state veterans cemetery in Irvine. The people have spoken – twice – on this issue. Accordingly, at the next Irvine City Council meeting, I will propose that the City Council adopt, as an ordinance, the recent citizens’ initiative calling for locating a state veterans cemetery at the originally designated ARDA site adjacent to the Great Park.

Adopting the initiative as an ordinance will finally settle this long-divisive issue in the way that the people of this City have now twice demanded — first, by their overwhelming rejection in 2018 of Measure B and the land exchange, and most recently, by gathering nearly 20,000 signatures expressing the residents’ desire to locate the veterans cemetery on the ARDA.

Adopting the citizen’s initiative as an ordinance would also allow construction of the much-needed Orange County State Veterans Cemetery to begin as early as possible without any further political delays.

I have been fighting for a veterans cemetery on the hallowed grounds of the former El Toro Marine Air Station for many years, beginning in 2013, long before I was elected to the City Council.  As I wrote to the Irvine City Council in early 2014:

“Orange County has a long and proud military tradition. Currently, more than two million veterans live in California – more than in any other state. This military tradition continues into the present, as nearly 7,000 veterans of the Iraq and Afghanistan wars live in Orange County. Yet Orange County veterans do not have their own official military cemetery and those in Orange County who want to visit a veteran’s grave in a national cemetery must travel to Riverside, San Diego or Los Angeles counties. It is time that Orange County offered its veterans – who have sacrificed so much for us – a final resting place close to their families and loved ones. I believe that a portion of the Great Park in Irvine, which was once the El Toro Marine Corps Air Station, would be an altogether fitting and proper location for this Orange County Veterans Cemetery, as well as a lasting memorial to the Great Park’s military heritage. As an Irvine resident and a member of the Irvine Community Services Commission – and as the daughter of an Orange County Korean War combat veteran – I urge you to create an Orange County Veterans Cemetery and, also, to locate this cemetery in a portion of the Great Park that was once the El Toro Marine Corps Air Station.”

On March 11, 2014, I cheered with others in the audience when the City Council unanimously voted to designate the Amended and Restated Development Agreement [ARDA] site in the Orange County Great Park in Irvine as the future site of a veterans cemetery. But when I became an Irvine City Councilmember in 2016, I learned that there had been no progress on a veterans cemetery in the intervening two years. The reason for this lack of progress, I was informed, was the high cost of the decontamination and demolition necessary on the ARDA site.

Because construction of a veterans cemetery at the ARDA site did not appear to be financially viable for the City of Irvine, I supported the Strawberry Fields site (and the land exchange with FivePoint) as a less expensive, more practical, and faster alternative to the ARDA site. This land exchange proposal became Measure B, which was placed on the ballot for the voters in June 2018. The land exchange was supported by the Orange County Veteran’s Memorial Park Foundation and many national and local veterans organizations, as well as both the Democratic and Republican Parties of Orange County. 

The voters, however, decisively rejected Measure B and the land exchange, with 63 percent opposed. I understood from the defeat of Measure B that Irvine residents did not trust the City Council to put the people’s interests ahead of the interests of Irvine’s powerful developers, and, specifically, did not want to risk the possibility that the land exchange with FivePoint that would lead to massive development and more traffic congestion.

Following the voters’ rejection of Measure B, it again seemed that the construction of a veterans cemetery at the Great Park had stalled. However, several members of the California State Legislature continued to look for a way to create an Orange County Veterans Cemetery on the grounds of the former El Toro Marine Base.

Assemblywoman Sharon Quirk-Silva, who taken the lead in earlier legislation regarding an Orange County Veterans Cemetery, introduced Assembly Bill 368, which requires the California Department of Veterans Affairs toJoining Democrat Sharon Quirk-Silva (AD 65) in support of this bill was a bipartisan group of Orange County legislators, including Republican Assemblymembers Tyler Diep (AD 72), William Brough (AD 73) and Philip Chen (AD 55), as well as Democrats Senator Thomas J. Umberg (SD 34) and Assemblymember Tom Daily (AD 69).  These legislators wrote to the Irvine City Council stating, “Today, we are ready to work with State and Federal officials to secure funding for the Southern California Veterans Memorial Park and Cemetery.  We ask that you stand by your previous commitment to provide a resting place for California veterans at the ARDA site.”

Most important to me, this legislation committed the State of California, rather than the residents of Irvine, to provide the funding for the veterans cemetery. Initially, the legislation specified state financial support only for the ARDA site. After pressure from FivePoint and Mayor Christina Shea, the bill was amended to apply to either the ARDA site or a new site now proposed by Mayor Christina Shea and developer FivePoint. This newly proposed site was called the “Golf Course” site because it was comprised, in part, of land in the Great Park that had originally been designated to become a city-run golf course. However, the new site also included land that had previously been designated as part of the Orange County Great Park’s long-awaited “Cultural Terrace,” meant to include museums, botanical gardens, and other very popular cultural amenities that the people of Orange County had been waiting for a very long time.

Crucially, this new and hastily unveiled “Golf Course” site has never been studied or evaluated – by either the City or the State — for use as a veterans cemetery. As a result, the claims of FivePoint and Mayor Shea that the Golf Course site is a significantly less costly alternative to the ARDA are wholly conjectural. The truth is, since we have not actually studied the question, we have no idea whether locating the veterans cemetery on the Golf Course site rather than the ARDA would save a penny for the taxpayers.

We do know, however, that FivePoint very much wants to develop the ARDA site. Of course, this development of the ARDA site by FivePoint can not happen if the ARDA becomes a veterans cemetery.

We also know that Mayor Shea very much wants FivePoint to be able to develop the ARDA. In fact, when discussing this new alternative site with a group of Great Park residents, Mayor Shea stated that her plan was to give FivePoint a 99-year lease for development on the ARDA. Mayor Shea further said that Golf Course site was really a “diversion” or “short-time solution” to buy time and ensure that the ARDA did not become a veterans cemetery. She made it clear that to her, whether a veterans cemetery was actually built on the Golf Course site – or anywhere in Irvine — was secondary to making sure that the ARDA site remained available for development by FivePoint. In other words, Mayor Shea and FivePoint still intended to do precisely what the voters in defeating Measure B had specifically rejected.

For these reasons, when it again came before the City Council in April 2019, I supported designation of the ARDA as the site for a veterans cemetery, for the State of California to “acquire, study, design, develop, construct, and equip a state-owned and state-operated Southern California Veterans Cemetery” on the grounds of the former El Toro Marine Base. Nevertheless, the Irvine City Council rejected the ARDA and designated the Golf Course site for a veterans cemetery by a vote of 4 to 1, with only myself opposed.

The citizens’ initiative drive followed. Advocates for the ARDA site were able to collect nearly 20,000 signatures of Irvine residents to force the City Council to locate the veterans cemetery at the ARDA or place the issue on the ballot in November 2020.

I have never approached this issue from a partisan perspective, or with concern for anything but properly honoring O.C. veterans like my father. My sole concern now — as it has been from the beginning of this effort — is doing whatever I can to ensure that an Orange County Veterans Cemetery becomes a reality.

My criteria for deciding where to locate the veterans cemetery has also remained consistent: I support the site that I believe is most viable, most likely to be completed, and at the least cost to Irvine taxpayers. That site is the ARDA.

Our veterans deserve a final resting place close to their families and loved ones. Veterans like my father have waited long enough for Irvine to do the right thing.

Let’s build an Orange County Veterans Cemetery at the ARDA without further unnecessary delay.

Let’s listen to the people.

Irvine Animal Care Center Reopens for Pet Adoptions By Appointment Only!

One member of my family doesn’t mind the COVID-19 stay-at-home order.  Chief, my 2-and-a-half-year-old Siberian Husky is delighted to have everyone at home, all day, every day, available for walks, treats, belly rubs, and just hanging out.

If you’ve been wishing you had a wonderful fuzzy quarantine companion, you’re in luck! 

In-person pet adoptions are now available by appointment at the Irvine Animal Care Center, which had closed to the public at the end of March due to the coronavirus pandemic.

I joined my colleagues on the Irvine City Council to authorize the center to open, making it the only City facility to reopen during the pandemic.  The facility has been open to staff caring for animals during the pandemic.

Potential adopters can make an appointment and have a pet-matching interview by phone.

Adoption applications can be completed online, and then once all steps are complete, adopters will be allowed to go to the center to meet the animals.

Adopters are asked to wear face masks in the center and comply with other precautionary measures against the coronavirus.

Those interested in adopting an animal can make an appointment starting at noon Thursday.

Pets available for adoption include dogs, cats, rabbits and rodents.

As a member of the Irvine City Council, I have made it a priority to support local business and ensure that our government operates with fiscal responsibility, openness, and transparency.

I’ve received the Orange County Taxpayers Watchdog Award for “demonstrating dedication to the protection of taxpayer funds and for the advocacy of government transparency and fiscal responsibility.”

Under my leadership, the Irvine Community Land Trust has received the Platinum Seal of Transparency from GuideStar, the world’s most respected source of information on nonprofit organizations.

I was also the only member of the Irvine City Council to oppose Measure D, which would have eliminated voter input into development decisions, because I believe that citizens must have a strong voice in deciding the future of their neighborhoods.

I enthusiastically supported the City’s adoption of the Irvine Sunshine Ordinance, which expanded public notice to four times longer than California law requires and prevents government action without full and informed participation from the community. I also supported approval of a two-year budget cycle, along with a five-year financial planning program, to bring more accountability to government spending.

I’ve often said that Government transparency and fiscal responsibility should be neither a conservative nor a liberal idea, but appeal to both, as we strive to address increasing social needs with limited resources.

The economic distress caused by COVID-19 will make this important task even more difficult.

COVID-19 has already impacted every facet of California’s economy, including the fiscal health of California’s government institutions, from large state agencies to cities and school districts. 

That’s why it will be especially valuable to hear from California State Controller Betty T. Yee on California’s fiscal health.

State Controller Betty T. Yee was elected in November 2014, following two terms of service on the California Board of Equalization. As Controller, she continues to serve the Board as its fifth voting member. Reelected for a second term as Controller in 2018, Ms. Yee is only the tenth woman in California history to be elected to statewide office.

As the state’s chief fiscal officer, Ms. Yee chairs the Franchise Tax Board and serves as a member of the California Public Employees’ Retirement System (CalPERS) and the California State Teachers’ Retirement System (CalSTRS) Boards. These two boards have a combined portfolio of more than $620 billion.

Ms. Yee has more than 35 years of experience in public service, specializing in state and local finance and tax policy. Ms. Yee previously served as Chief Deputy Director for Budget with the California Department of Finance where she led the development of the Governor’s Budget, negotiations with the Legislature and key budget stakeholders, and fiscal analyses of legislation. Prior to this, she served in senior staff positions for several fiscal and policy committees in both houses of the California State Legislature. She also co-founded the Asian Pacific Youth Leadership Project, which exposes California high school youth to the public service, public policy, and political arenas.

A native of San Francisco, Ms. Yee received her bachelor’s degree in sociology from the University of California, Berkeley, and she holds a master’s degree in public administration.

Watch Melissa Fox’s Town Hall on Small Business Assistance, Affordable Housing, and COVID-19 with California State Treasurer Fiona Ma and Small Business Majority’s Claudia Moreno

COVID-19 has impacted both small businesses and housing in California.

In this Town Hall held on Wednesday, April 29, 2020, Irvine City Councilmember Melissa Fox , California State Treasurer Fiona Mam and Claudia Moreno of Small Business Majority discuss the impact of COVID-19 on California’s economy, small business assistance programs, and new opportunities for affordable housing.

Fiona Ma is California’s 34th State Treasurer. She was elected on November 6, 2018, with more votes (7,825,587) than any other candidate for treasurer in the state’s history. She is the first woman of color and the first woman Certified Public Accountant (CPA) elected to the position.

Claudia Moreno is an Southern California Outreach Director for Small Business Majority, a national small business advocacy organization. She previously worked at the White House during the Obama Administration in the Executive Office of Presidential Correspondence where she served as an intermediate between the President and the American people. She also took lead in the Office’s Spanish Analytical Department as an interpreter to support the President’s vision to serve all communities.

Melissa Fox is an Irvine City Councilmember and an attorney, and also serves as Chair of the Irvine Community Land Trust, dedicated to building more affordable housing.

Irvine City Council Okays Lease for New Wild Rivers Water Park at the Great Park!

At last night’s Irvine City Council meeting, I was delighted to join my colleagues in voting to approve the lease agreement enabling the return of Wild Rivers Water Park to Irvine, with a new location in the Orange County Great Park.

///ADDITIONAL INFORMATION: wildrivers – 9/6/10 – LEONARD ORTIZ, THE ORANGE COUNTY REGISTER – Thousands of people enjoyed the waters at Wild Rivers water park in Irvine as the park enters it’s last week before closing for the season. According the the year-to-year lease the park has with the Irvine Company the park will remain open for the 2011 season.

I have been working to bring Wild Rivers back to Orange County since 2017, when I successfully asked the Irvine City Council, acting as the Great Park Board of Directors, to approve construction of a new Wild Rivers Water Park at the Orange County Great Park.

Under the lease agreement, the City of Irvine will receive 4.5% of the park’s annual gross revenue as a lease payment, and if the park remains closed for the summer or underperforms, the City is still set to receive a lease payment of $550,000 for that year. The annual lease is expected to bring in anywhere from $550,000 to $1 million to the City, according to a report prepared by City staff.

Wild Rivers will pay for the construction of the water park, while the City will pay for and maintain a parking lot with over 1,200 spaces for Wild Rivers use during the summer, but managed by the City the remainder of the year.

The old Wild Rivers Water Park opened in July 1986 on the site of the former Lion Country Safari, now the site of Los Olivos Apartments. Following the expiration of its lease with The Irvine Company, it closed permanently on September 25, 2011.

The new Wild Rivers Water Park will be located on 20 acres in the heart of the Great Park, at the intersection of Skyhawk and Great Park Blvd.

Wild Rivers will build a new water park with waterslides, an uphill water coaster, water play structures for children, a wave pool, a lazy river and Wild Rivers’ popular Congo River Rapids.  I have also been working with Wild Rivers management to create an “all access” area, so that children and adults with disabilities can also enjoy a day at the water park.

We have missed having a water park in Irvine.  I was a kid sliding down the water slides at the old Wild Rivers and I was a young mom taking my son there on hot summer days.  We know that Wild Rivers provides fun and safe water parks, and they’ve always had a great relationship with the residents of Orange County.  We look forward to having them back very soon.  In fact,  we can anticipate a Grand Opening sometime in 2021!

 

Irvine Should Require COVID-19 Protections for Nursing Home Patients and Staff

Nursing homes in California have been hit hard by COVID-19. 

As the Los Angeles Times points out, “Nursing homes have become a tragic focal point of the coronavirus outbreak, with their elderly residents, many of whom have underlying health conditions, accounting for a large percentage of COVID-19 deaths across the country. More than 30% of those who have died in Los Angeles County were residents of long-term care facilities; more than 70% of the deaths in Long Beach have been nursing home residents.”

Nationally, outbreaks in nursing homes and assisted living centers have been among the most quick-spreading and deadly of the crisis.

Long-term care facilities have accounted for at least 221 deaths in Washington, or about half of the deaths in the state. In New York, more than half of nursing homes have positive cases, and more than 1,700 people in such facilities, about a third of nursing home residents with COVID-19, have died.

Yet, even as deaths from COVID-19 continue to climb in California, especially among older people, our state, county and local governments have not acted with the decisiveness needed to protect our most vulnerable population.

The Los Angeles Times reports that “As the novel coronavirus continues to tear through nursing homes, state and local governments have been slow to inform the public about the scope of the crisis. The state’s list, which officials have promised to update regularly, does not show how many people have died at each facility. It is also plagued by apparent omissions and undercounts. For weeks, the Los Angeles County Department of Public Health has been publishing names of group living facilities with COVID-19 cases, without specifying how many people have tested positive at each place. Some of those homes do not appear on the state list. The state list also does not include data from California’s 7,461 residential care facilities.”

The Los Angeles Times further explained that “Dotting the state are nursing homes where the deadly contagion has taken hold. In San Bernardino County, at least 25 people have died, about half of them residents of nursing homes and assisted living facilities. At least 94 confirmed cases came from a single facility in Yucaipa where 10 residents have died. Four people have died and 38 others have tested positive for the virus at the Kensington assisted living facility in Redondo Beach. More outbreaks have been reported in Orinda, San Jose, Burlingame and San Francisco. At a care center in Hayward, 49 staffers and residents tested positive.”

As the devastating impact of COVID-19 on nursing home patients (and staff) comes into sharper focus, many jurisdictions have taken steps to alleviate the crisis and reduce the number of deaths by requiring special protections for nursing home patients.

I believe that our nursing home patients and staff in Irvine also need and deserve these special protections.

Accordingly, at the next Irvine City Council meeting, I will propose that City of Irvine staff determine the protocols relating to preventing the spread of COVID-19 that are currently being followed at nursing home facilities within the City; what additional measures and protocols other jurisdictions are now requiring to protect residents and staff in the subject facilities, and that City staff make recommendations regarding actions to be considered and taken by the City Council to provide additional special protections for nursing home residents and staff during the COVID-19 crisis.

These additional protections may include:

1) Limiting entry into Licensed Congregate Health Care Facilities;
2) Prohibiting employees who have tested positive for or who exhibit symptoms of COVID-19 from returning to work until having fulfilled CDC Criteria for Return to Work;
3) Suspending communal dining and activities;
4) Providing separate areas and staff for those with COVID-19;
5) Requiring all staff to wear a surgical masks at all times in the facility;
6) Requiring all staff to follow all infection prevention guidance from the Centers for Medicare and Medicaid Services and the CDC;
7) Requiring all residents and patients to wear a surgical mask or clean face covering when outside their room;
8) Requiring symptom screening for all; and
9) Requiring daily temperature checks for staff, patients, and residents. 

My goal, as with other matters related to preventing the spread of COVID-19, is to ensure that Irvine’s residents and businesses have the most effective and appropriate help from government that we are able to provide, guided first and foremost by the advice of medical and public health professionals.

Fiona Ma is California’s 34th State Treasurer. She was elected on November 6, 2018 with more votes (7,825,587) than any other candidate for treasurer in the state’s history.

She is the first woman of color and the first woman Certified Public Accountant (CPA) elected to the position.

Melissa Fox is an Irvine City Councilmember and an attorney, and also serves as Chair of the Irvine Community Land Trust, dedicated to building more affordable housing.

Claudia Moreno develops relationships with both business partners and small business owners across the region to discuss ways to best help small businesses thrive in their local economies. Claudia also works closely on statewide policy initiatives. The daughter of a small business owner, Claudia understands the importance of giving back to her community and intentionally working to empower under-served entrepreneurs.

She previously worked at the White House during the Obama Administration in the Executive Office of Presidential Correspondence where she served as an intermediate between the President and the American people. She also took lead in the Office’s Spanish Analytical Department as an interpreter to support the President’s vision to serve all communities.

Happy Earth Day 2020!

Today, Wednesday, April 22, is Earth Day.

Nearly 50 years ago, on April 22, 1970, millions of people took to the streets to protest the negative impacts of 150 years of industrial development.

In the US and around the world, smog was becoming deadly and evidence was growing that pollution led to developmental delays in children. Biodiversity was in decline as a result of the heavy use of pesticides and other pollutants.

The global ecological awareness was growing, and the US Congress and President Nixon responded quickly.  In July of the same year, they created the Environmental Protection Agency, and robust environmental laws such as the Clean Water Act and the Endangered Species Act, among many.

Earth Day is now a global event each year, and more than 1 billion people in 193 countries now take part in what is the largest civic-focused day of action in the world.

The City of Irvine has been a leader in earth-friendly environmental policies, green technology, and environmental awareness.  Irvine’s environmental programs have been on the leading edge of advances in green building and construction, environmental education, recycling, water conservation, waste disposal, and energy-saving.

Under Irvine Mayors Larry Agran, Beth Krom and Sukhee Kang, Irvine was indeed a world leader in environmental programs and innovation. One of the highlights of Irvine’s environmental engagement was presence of the U.S. Solar Decathlon at the Orange County Great Park in Irvine. The Solar Decathlon is an international competition held every two years that challenges collegiate teams to design, build, and operate solar-powered houses that are cost-effective, energy-efficient, and attractive. The houses are assembled at a central location for display, evaluation, and awards. The winner of the competition is the team that best blends affordability, consumer appeal, and design excellence with optimal energy production and maximum efficiency. The Solar Decathlon was held at the Great Park in 2013 and 2015.

Another highlight of Irvine’s environmental leadership was the creation of the Green Ribbon Environmental Committee in 2012.  The Green Ribbon Committee was charged with the crucial task of developing and recommending environmental policy initiatives and programs, including sustainability policies related to energy, recycling and waste management, mobility, open space and water issues.

Unfortunately, when Steven Choi became mayor of Irvine in November 2014, both the Great Park Solar Decathlon and the Green Ribbon Committee became victims of Choi’s climate change denial and hostility to environmental action.

As I’ve detailed in How Orange County Lost the U.S. Solar Decathlon, Steven Choi was hostile to the very premises of the Solar Decathlon — the need for replacing burning fossil fuels with renewable sources of energy.  In sharp contrast to the previous three Irvine mayors who championed environmental and climate concerns, Choi “completely question[ed] the idea of global warming being caused by human intervention.”  Rather than recognizing the importance of environmental action,  both as an opportunity for technological innovation and as an existential imperative, Choi saw all environmental concerns as anti-business and climate change as wholly unconnected to human activity. You can read the full story of the Solar Decathlon here.

Similarly, Choi sabotaged the Green Ribbon Environmental Committee. In fact, when I was elected to the Irvine City Council in November 2016, the Irvine Green Ribbon Environmental Committee had been inoperative for several years because Mayor Steven Choi and his allies on the Irvine City Council did not appoint sufficient members to constitute a quorum. In fact, the Committee did not meet during all of 2014 and 2016, cancelling every scheduled meeting. The words “climate change” and “global warming” were not permitted to be used in official City of Irvine publications or staff reports. Choi didn’t even allow the City of Irvine to participate in the Annual National Mayor’s Challenge for Water Conservation, sponsored by the Irvine-based Wyland Foundation.

As a longtime environmental activist, I wasn’t going to allow the City of Irvine to continue to ignore environmental issues and global warming. I convinced newly elected Mayor Donald P. Wagner, who replaced Steven Choi, to re-invigorate the Green Ribbon Environmental Committee and appoint me to the Committee as the City Council’s representative.  I then appointed Krishna Hammond, a young progressive scientist, as my representative to the Committee and encouraged the other Councilmembers to make appointments.  At our first meeting, I was elected Chair of the Committee and Krishna was elected Vice Chair. The Green Ribbon Environmental Committee was out of Choi-imposed exile and was off and running.

A crucial environmental issue facing Irvine in the near future is whether to switch from purchasing energy from SoCal Edison to utilizing a Community Choice Energy provider.

Community Choice Energy (CCE) is a program that brings local control and freedom of choice and competition into the electricity marketplace. Community Choice allows cities and counties to purchase power on behalf of their residents and businesses to provide cleaner power options at a competitive price.

We’ve made progress since the days when Steven Choi drove the U.S. Solar Decathlon out of town, shut down the Green Ribbon Environmental Committee, refused to participate in the Wyland Foundation’s Water Challenge, and banned the words “climate change” and “global warning.”

But there is still much to be done. In particular, the current Irvine City Council leadership needs to show that its professed concern for action on climate change and protecting the environment isn’t just lip service and a public relations smokescreen.

Instead, the City Council needs to adopt a stand-alone Climate Action Plan that we’ve been promised and implement the Community Choice Energy program that we’ve shown to be a tremendous benefit to both the City and the planet.

Dr. Strack is a licensed psychologist and certified sport psychology consultant (CMPC). Over the past 15 years he has consulted H.S./Collegiate athletes, professional athletes (MLB, MiLB, NHL, PGA, NBA, Professional Soccer/USL), and Olympic athletes (Women’s Indoor Volleyball, Speed Skating, Swimming, Fencing).

He is a former division I college baseball player and founding partner of Proball Inc., private baseball academy. During the 1999 and 2000 MLB seasons, he was the batting practice pitcher for the Anaheim Angels. From 1999 to 2004, he was hand-picked to pitch in the MLB Players’ Association and ESPN’s Big League Challenge Home Run Contests where he was the personal pitcher for Barry Bonds, Alex Rodriguez, Raphael Palmeiro, Jose Canseco, Shawn Green, Magglio Ordonez, Andruw Jones, and Troy Glaus.

Dr. Ben Strack is a United States Olympic Committee (USOC) Sport Psychology Registry Member, board member of the Orange County Psychological Association and a co-chairperson for the Optimal Performance/Functioning division of the Association of Applied Psychophysiology and Biofeedback. He is also an active member of the American Psychological Association (APA) and the Association for Applied Sport Psychology (AASP).

As an adjunct professor at California State University Long Beach and Argosy University, Dr. Ben Strack taught sport psychology classes in the undergraduate and graduate programs. He is also a frequent speaker at workshops and conferences throughout the country. His work with athletes has appeared in various media including ESPN, The New York Times, and on local television shows in Southern California.

I’ve always loved reading children’s stories out loud.  During this time of social distancing, I’ve decided to make some videos of me reading children’s books aloud in the hope that your children might find these stories entertaining.

Next is “The Story Book Knight” by Helen Docherty & Thomas Docherty.  Here is a lovely tale about a gentle knight and the power of a good story. Even dragons love a good story!

Feeling like you need some more space? Bear and Mousie are having issues too! Here’s a great next story called “There’s a Bear in My Chair” by Ross Collins that’s perfect for quarantine!

Our next story is one of my favorites, especially when you’re not feeling too happy and want to complain — like many of us feel at times during this quarantine! This wonderful story called “Penguin Problem” by Jory John is about a complain-y penguin and has some wise advice from Walrus that might be very helpful right now.

Child Care is Now Available for Essential Workers in Orange County!

Early Childhood OC is working with agencies across Orange County to compile a searchable database of currently open child care centers and family child care homes serving children aged birth – 12.

This database will be updated every Friday.

Governor Newsom’s executive order allows essential workers to access child care payment assistance, regardless of their income, while schools are closed because of COVID-19.

Children’s Home Society of California (CHS) has three Child Care Payment Programs that provide subsidized child care services to eligible families: Alternative Payment, CalWORKs, and Family Child Care Home Education Network programs.

Through these programs, in Fiscal Year 2018, CHS provided services to over 9,700 children and over 5,500 families. In all, more than 2,099,000 days of care were provided to children across California.

Celebrate “The Week of the Young Child” at Home with Pretend City Children’s Museum!

The Week of the Young Child (April 11-17) is an annual celebration hosted by the National Association for the Education of Young Children (NAEYC) celebrating early learning, young children, their teachers, and families.

Unfortunately, this year, young children are stuck at home, away from their schools, teachers, and friends.

The good news is that although Irvine’s Pretend City Children’s Museum is temporarily closed to prevent the spread of COVID-19, it has made it easier to celebrate the Week of the Young Child from your home — and keep your young children moving, thinking, and expressing throughout this quarantine period.

The staff at Pretend City has said, “We want to share our sincere hope that you and your loved ones are staying safe and healthy. As we continue to monitor COVID-19, our top priority remains the well-being of our Pretend City citizens -– all of you! While we’re adapting to new ways of serving you while the museum is temporarily closed, our team is committed to working together to support you.”

Pretend City has put together some fun at-home activities for young children for every day of the week.

Pretend City has also put together a terrific “Way to Play Guide” for Pretend City @ Home, providing age and development appropriate play activities for children from birth to 6 months old, 7 to 12 months old, 13 to 18 months old, 19 to 24 months old, 2 to 3 years old, 3 to 4 years old, 4 to 5 years old, and 5+ years old.

Irvine Child Care Spots Available for Essential Workers!

I am pleased to announce that Irvine has several hundred spots now open for child care for essential workers.

I currently serve as the Irvine City Council’s representative on the board of directors of the Irvine Child Care Project, along with other representatives from the City of Irvine and Irvine Unified School District. 

Established in 1984, the Irvine Child Care Project (ICCP) is a Joint Powers Agreement between the Irvine Unified School District and the City of Irvine, overseen by the Irvine Child Care Project Board of Directors. It is a unique partnership in which the City of Irvine and the Irvine Unified School District collaborate to accommodate more affordable and quality child care in the City.

On Thursday, April 9, 2020, the ICCP Board had a virtual meeting to discuss some of the critical needs of the ICCP during the COVID-19 crisis.  We made several important decisions at this meeting to help facilitate and increase the availability of child care for essential workers during the COVID-19 crisis.

Crucially,  we voted to waive rental payments from ICC providers for April, May, and June.  Waiving the rent for these providers means that essential child care services will remain accessible to families in need of child care during this crisis. 

Currently, 10 out of the 28 ICCP programs are open to serve children of essential critical infrastructure workers. The sites that are open are located on the following campuses: Canyon View Elementary, Deerfield Elementary, Oak Creek Elementary, Plaza Vista Elementary, Springbrook Elementary, Stonegate Elementary, Turtle Rock Elementary, University Park Elementary, Vista Verde Elementary, and Woodbury Elementary.

These 10 sites currently have the space to enroll approximately 200 additional children. 

If you are an essential critical infrastructure worker and need child care, please click here to access a searchable database of currently open child care centers and family child care homes serving children aged birth –1 2 compiled by Early Childhood OC.  This database will be updated every Friday. The Countywide list linked above lists all open programs in Orange County including, ICCP locations.  In addition, each ICCP location below is identified as OPEN or CLOSED.

Kiddie Academy of Irvine, Prestige Preschool Academy and several family child care providers are open and able to serve school age children, including non-residents.  These programs would be able to serve at least 100 additional children (combined capacity), even with the new guidance from the state regarding decreased capacities for best health and safety practices.  Contact information for each of these programs is available in the searchable database of currently open child care centers and family child care homes compiled by Early Childhood OC. This database is updated weekly.  I anticipate the number of providers on this list to increase as programs re-open to provide emergency child care to essential workers.   Several providers have contacted child care coordination this week to discuss their plans to re-open.

ICCP sites (10 open operated by Child Development Incorporated) are only able to serve Irvine residents and/or children enrolled in the IUSD school district. This is based on the Joint Powers Agreement between the City of Irvine and the Irvine Unified School District.  The ICCP Board has the authority to waive this stipulation, if that is something that the Board would be interested in considering at the May meeting.

Tell the Orange County Board of Supervisors to Require Face Coverings for All Food Service, Grocery, and Other Essential Workers!

Did you know that every neighboring county of Orange County requires face coverings for all food service, grocery store, and other essential workers except Orange County?

Did you know that many of these workers are under the age of 18?

In order to stop the spread of COVID-19 and to protect both workers and customers, every neighboring county of Orange County — including San Diego, Riverside, San Bernardino and Los Angeles Counties — now require face coverings for all food service, grocery store, and other essential workers.

Only Orange County does not. I believe this failure to protect public health is unacceptable and unconscionable.

My friend, Gina Clayton-Tarvin, President of the Board of Trustees at the Ocean View School District, who has also been a classroom teacher in Orange County for 25 years, has started a petition to address this very serious problem.

The petition calls on Michelle Steel, Chair of Orange County Board of Supervisors, to “allow a vote to order face coverings for all food service, grocery store, and other essential workers, many of whom are children under the age of 18, to stop the spread of COVID-19 in Orange County.”

I have signed this petition because I believe that all workers who are providing us with food, groceries, and other essential goods and services during this pandemic deserve to be as protected from this deadly virus as possible.

As customers of these businesses and as residents of Orange County, we also deserve to be protected.

The protection of public health is an essential responsibility — and must be a top priority — of any government.

As a member of the Irvine City Council, I have already voted to require all retail workers in Irvine to wear face coverings.

Our Orange County Supervisors need to step up now and do the same, and stop putting our food, grocery and other essential workers — and ourselves — in unnecessary danger of contagion and death.

Irvine Orders All Retail Personnel to Wear Face Coverings

Irvine.FaceMasks.01Effective Wednesday, April 8, 2020, by order of the City Manager in his capacity as Director of Emergency Services,  all retail personnel in the City of Irvine will be required to wear face coverings.

This executive order applies to all retail businesses in Irvine, including, but not limited to:face-mask-480x240

  • Grocery stores
  • Pharmacies
  • Restaurants providing take-out or delivery services
  • Banks, Savings and Loans, and Credit Unions
  • Home Improvement stores
  • Gas Stations
  • Convenience stores

The use of cloth face coverings could reduce the transmission of COVID-19 by individuals who do not have symptoms and may reinforce social distancing. Face coverings can include items such as bandanas, fabric masks, and neck gaiters.

It is important to note face coverings are not a substitute for social distancing and hand washing, which remain our most important line of defense against the spread of COVID-19.

Irvine Community Land Trust Continues Mission of Providing Affordable Housing During COVID-19 Crisis

Last week, my colleagues on the Board of Directors of the Irvine Community Land Trust (ICLT) unanimously elected me to serve another year as Chair.  I am grateful for their support and for the opportunity to continue to lead the important work of the Land Trust in this difficult time.

As we fight this deadly outbreak, secure and affordable housing has never been more important.

I’m very happy that California Governor Newsom has issued an Executive Order halting evictions due to non-payment of rent due to medical or financial consequences of COVID-19.  Adding to California’s already far too high 150.000 homeless population would make it even more difficult for us to stop the spread of the virus.

At our next meeting, which will be conducted electronically and to which the public is invited, we will be adopting new measures to help our tenants deal with the COVID-19 emergency, including rent deferments and other forms of assistance.

Our Executive Director of the Irvine Community Land Trust, Mark Asturias, has released the following statement in regard to ICLT’s response to COVID-19:

“Greetings,

There’s no shortage of uncertainly in the world lately, so I’d like to take a moment to tell you exactly how the Irvine Community Land Trust is navigating the post-COVID world.

As an affordable housing nonprofit, our communities are comprised of some of Irvine’s most vulnerable populations, even when there isn’t a global crisis weighing on them. No matter the circumstances, we remain steadfast in our commitment to our residents and to ensuring they have a place they can be proud to call “home.”

We will not falter, but we are doing things a little differently to best protect the health and safety of our staff, board members, residents and partners in the community.

For starters, we’re observing social distancing by moving our regular public board meetings online. Earlier this week, we held the ICLT’s first online board meeting, utilizing both Zoom and a public phone line to great effect. Information on joining our future digital meetings will be posted as available at http://www.irvineclt.org/agenda.

At each of our properties – Parc Derian, Alegre and Doria – we’re working with property managers to ensure residents are equipped with the knowledge and resources they need to navigate these trying times.

Through a series of special government protocols, we’re continuing construction on our new community, Salerno. Out of concern for our construction workers, we’re also undertaking extraordinary measures to ensure they stay safe and healthy while on the job. And, in cooperation with our community partners, we’re continuing our work to make Irvine the best it can be, no matter the challenges we face.

In the coming weeks, the next edition of our newsletter will be delivered as usual, packed with the latest and greatest from the ICLT. For now, rest assured that our commitment to our mission burns stronger than ever as we rise to face this unprecedented situation.

California Governor Orders Halt in All Evictions Due to COVID19

Today California Governor Gavin Newsom issued a new Executive Order halting all evictions statewide for those affected by COVID19.

The measure prevents the evictions of renters over the nonpayment of rent through May 31.

It covers those who have lost work because of the pandemic, have become sick or have had to take care of family members with COVID19. Law enforcement and the court system also would be prohibited from executing evictions while the order is in effect.  Renters are required to eventually pay all the rent they owe, and must notify their landlords in writing within seven days of their nonpayment.

In an earlier Executive Order, Governor Newcom had given authority to local governments to ban evictions due to COVID19 for 60 days.  Many cities had exercised this power to halt evictions, including Anaheim and Costa Mesa in Orange County, as well as San Diego, Long Beach, San JoseLos AngelesLong BeachEl MonteFresnoSan Francisco,  CamarilloOjaiOxnardThousand OaksMoorpark, and Santa Monica.

The Governor’s new order is especially welcome in cities like Irvine, where this week, by a 4-1 vote, the Irvine City Council refused even to vote on my motion to order a legal moratorium on evictions due to the COVID19 crisis, opting instead to “strongly encourage” landlords not to seek evictions by passing a non-binding resolution with no legal force. I voted No because Irvine renters need real protection but the resolution passed by the Council has absolutely no legal force or effect. 

Now, renters in all California cities — including Irvine — are protected from eviction due to COVID19.

“Irvine Neighbors Helping Irvine Neighbors” — City of Irvine and Families Forward Host Food Collection Event on Sat., March 28

City of Irvine staff has coordinated with Families Forward, an Irvine-based non-profit dedicated to helping low income & homeless families, for an “Irvine Neighbors Helping Irvine Neighbors” Food Collection event this Saturday, March 28 from 9 a.m. to 12 p.m.

The event will be held at two locations — the Irvine Civic Center (north parking lot next to the Child Care Center) and at the Orange County Great Park (Lot 2, Festival Lot).

Since the COVID-19 outbreak, food assistance requests to Families Forward have increased 500%.

They are in most need of the following items:

  • Cereal
  • Peanut Butter
  • Canned Chicken
  • Canned Tuna
  • Pasta Sauce
  • Dried Pasta
  • Baby Wipes

Familes Forward.donate-page-with-familyThe event will be staffed by Families Forward volunteers as a “drop-and-go” with items being removed from the trunk of vehicles to adhere to social distancing requirements. Participants are required to remain in their vehicles.

A traffic safety plan has been developed for both sites with the assistance of Irvine Public Works & Transportation, Public Safety, and Community Services staff to facilitate anticipated traffic.

Families Forward is an Orange County, California, non-profit that exists to help families that are homeless or at-risk of homelessness achieve and maintain self-sufficiency through housing, food, counseling, education, and other support services. It assists families in financial crisis to achieve and maintain self-sufficiency. As Families Forward explains, “We do not just provide support; we supply the tools for families to once again become independent, productive residents of the community.”

Creating Affordable Housing in Irvine: Read the Irvine Community Land Trust 2019 Annual Report!

I am honored to serve as Chair of the Irvine Community Land Trust (ICLT), guiding its mission of providing secure, high-quality affordable housing for the benefit of income-eligible families.  Located in Irvine, California, the heart of Southern California’s most expensive real estate market, there is a tremendous need for affordable housing. Because this is our home, too, ICLT is committed to ensuring that Irvine is a place everyone can call “home.”

Recently, ICLT has released its 2019 Annual Report, which I want to share with you.

We are proud of our progress in this critical area for our community and recognize that there is much more work to be done in 2020 and beyond.

We at the Irvine Community Land Trust are extremely proud to put a successful 2019 to bed. It was a landmark year for our nonprofit organization, marked by critical milestones, a host of awards and a major legislative accomplishment that will benefit the affordable housing landscape across California for decades to come.

Progress on Salerno as of Feb. 2020. Groundbreaking on Sept. 19, 2019. Completion expected Fall 2020.

Most importantly, though, 2019 saw the birth of new, high-quality affordable rental housing for the benefit of income-eligible families.

Due to our robust economy and desirable standard of living, Irvine remains one of the most expensive real estate markets in the nation.

Unfortunately, affordable housing is extremely limited and our working-class citizens, who are the backbone of the city, are among some of Irvine’s most vulnerable residents. With them in mind and in our hearts, we were thrilled to break ground on Salerno, the ICLT’s newest community which will bring 80 affordable homes to the city, including 15 for veterans, 10 for individuals with disabilities and 10 for families at risk of homelessness.

The homes at Salerno are growing by leaps and bounds, and have now climbed up to include a third floor. Keep checking back for more progress pictures from the site, and look forward to the community opening its doors later this year.When completed in the fall, Salerno will join Parc Derian, Alegre Apartments and Doria Apartment Homes as places where income eligible residents will proudly call Irvine “home.”

As the Orange County Register observed, these affordable communities offer “a new beginning for veterans, developmentally disabled people and families at risk of homelessness.”

Looking ahead, 2020 is shaping up to be equally exciting as we begin work on our first home ownership community, Native Spring. That will prove to be a real game-changer for us, the city and, of course, the new homeowners! For the first time, the Irvine Community Land Trust will build for-sale homes that hard-working Irvine residents making less than $100,000 can actually afford to buy.

The Native Spring homeownership project will serve moderate-income families with a 68-house development in Portola Springs that will have all the features of any market rate for-sale project in the city. A young couple earning $76,000 to $94,000 annually will be able to purchase a home for about $370,000.

Additionally, these homebuyers will “pay it forward” by agreeing to resale provisions that keep these homes permanently affordable. This development, which will break ground in 2020, is tremendously exciting for the ICLT as it stands to make the American dream a reality for many first time home buyers.

Semper Fi: Farewell to Irvine 2/11 Marine Corps Beloved Mascot Sir Champ

Early this morning, I received the sad news that Sir Champ, the beloved mascot of our Irvine 2/11 Marine Adoption Committee, had passed away.

The message stated. “We will always treasure the photos of him with your Dad from all the past events.”

Today, the Irvine 2/11 Marine Adoption Committee posted the following statement on Facebook:

“It is with extreme sadness, we share the news that our beloved “Sir Champ” passed away February 5, 2020. Sir Champ served IMAC as their official mascot and ambassador to the community for years. As in true form, Sir Champ attended our IMAC volunteer meeting this past Tuesday evening, never missing a chance to bring joy to those around him. There are no words to describe the sorrow in our hearts or how much he will be missed. Our thoughts & prayers go out to “his human”, Rick. Thank you Rick for sharing Sir Champ with us and touching so many lives. RIP Sir Champ. You have served IMAC, your community & the 2/11 Marines proudly.”

I want to add my voice to those whose hearts were touched and our spirits lifted by Sir Champ, who served loyally at scores of City events representing the Irvine 2/11 Marine Adoption Committee with dignity and dedication.

Always true to the Marine Corps motto, Semper fidelis, Sir Champ will be remembered and missed by all.

About the Irvine 2/11 Marine Adoption Committee

The 2nd Battalion, 11th Marine Regiment, 1st Marine Division (2/11) from Camp Pendleton, was officially “adopted” by the City of Irvine at the Irvine Civic Center on September 15, 2007.

The City of Irvine and the 2/11 Marines made a pledge to encourage mutually beneficial interactions between the community and the battalion.

The Irvine 2/11 Marine Adoption Committee, a 501(c)(3) non-profit organization, encourages the community to support our adopted Battalion by participating and donating to a variety of activities, including charitable and educational activities and support, such as holiday and pre-deployment events, care packages, toy drives and more. for the benefit and welfare of the United States Marines and their families.

The 1st Marine Division is oldest, largest and most decorated division in the United States Marine Corps. The 2d Battalion, 11th Marines (2/11) is a 155mm howitzer battalion based at Camp Pendleton, California. Its primary mission is to provide artillery support to the 5th Marine Regiment in time of conflict. At any time, the command has roughly 750 Marines and Sailors assigned to it.

The battalion’s exemplary service ranges from France in World War I to the Battles of Guadalcanal and Okinawa in the Pacific in World War II to Inchon and the Chosin Reservoir in the Korean War to Hue and Phu Bai in Vietnam to Operations Desert Shield and Desert Storm in the Gulf War to Operation Enduring Freedom in Kuwait to the more recent and still-ongoing campaigns in Iraq and Afghanistan.

Stand Up for What is Right: California Governor Newsom Declares “Fred Korematsu Day”

“If you have the feeling that something is wrong, don’t be afraid to speak up.” — Fred T. Korematsu (1919-2005)

Fred Korematsu, a Californian who challenged the constitutionality of the internment of Japanese Americans during the Second World War, was born 101 years ago on January 30, 1919.

Although Koresatsu lost his case in 1944, his fight against racism and for justice has been vindicated by history.

This week, Governor Gavin Newsom today issued a proclamation declaring January 30th as Fred Korematsu Day in the State of California.

Fred Toyosaburo Korematsu was born in Oakland, California, on January 30, 1919, the third of four sons to Japanese-American parents Kakusaburo Korematsu and Kotsui Aoki, who immigrated to the United States in 1905. He attended public schools, participated in the Castlemont High School (Oakland, California) tennis and swim teams, and worked in his family’s flower nursery in nearby San Leandro, California.

When called for military duty under the Selective Training and Service Act of 1940, Korematsu was rejected by the U.S. Navy due to stomach ulcers. Instead, he trained to become a welder in order to contribute his services to the defense effort. First, he worked as a welder at a shipyard. He went in one day to find his timecard missing; his coworkers hastily explained to him that he was Japanese so therefore he was not allowed to work there. He then found a new job, but was fired after a week when his supervisor returned from an extended vacation to find him working there. Because of his Japanese descent, Korematsu lost all employment completely following the attack on Pearl Harbor.

On March 27, 1942, General John L. DeWitt, commander of the Western Defense Area, prohibited Japanese Americans from leaving the limits of Military Area No. 1, in preparation for their eventual evacuation to internment camps. Korematsu underwent plastic surgery on his eyelids in an unsuccessful attempt to pass as a Caucasian, changed his name to Clyde Sarah[13][14] and claimed to be of Spanish and Hawaiian heritage.

On May 3, 1942, when General DeWitt ordered Japanese Americans to report on May 9 to Assembly Centers as a prelude to being removed to the internment camps, Korematsu refused and went into hiding in the Oakland area. He was arrested on a street corner in San Leandro on May 30, 1942. Shortly after Korematsu’s arrest, Ernest Besig, the director of the American Civil Liberties Union in northern California, asked him whether he would be willing to use his case to test the legality of the Japanese American internment. Korematsu agreed.

Korematsu felt that “people should have a fair trial and a chance to defend their loyalty at court in a democratic way, because in this situation, people were placed in imprisonment without any fair trial.” On June 12, 1942, Korematsu had his trial date and was given $5,000 bail (equivalent to $76,670.06 in 2018). After Korematsu’s arraignment on June 18, 1942, Besig posted bail and he and Korematsu attempted to leave. When met by military police, Besig told Korematsu to go with them. The military police took Korematsu to the Presidio. Korematsu was tried and convicted in federal court on September 8, 1942, for a violation of Public Law No. 503, which criminalized the violations of military orders issued under the authority of Executive Order 9066, and was placed on five years’ probation.

He was taken from the courtroom and returned to the Tanforan Assembly Center, and thereafter he and his family were placed in the Central Utah War Relocation Center in Topaz, Utah. As an unskilled laborer, he was eligible to receive only $12 per month (equivalent to $184.01 in 2018) for working eight-hour days at the camp. He was placed in a horse stall with a single light bulb, and later said “jail was better than this.”

When Korematsu’s family was moved to the Topaz internment camp, he later recalled feeling isolated because his imprisoned compatriots recognized him and many, if not most, of them felt that if they talked to him they would also be seen as troublemakers.

Korematsu then appealed to the U.S. Court of Appeals, which granted review on March 27, 1943, but upheld the original verdict on January 7, 1944. He appealed again and brought his case to the United States Supreme Court, which granted review on March 27, 1944. On December 18, 1944, the Court issued Korematsu v. United States, a 6–3 decision authored by Justice Hugo Black, in which the Court held that compulsory exclusion, though constitutionally suspect, was justified during circumstances of “emergency and peril.”

Dissenting Justice Frank Murphy criticized what he called a “legalization of racism.” Justice Murphy added: “Racial discrimination in any form and in any degree has no justifiable part whatever in our democratic way of life. It is unattractive in any setting, but it is utterly revolting among a free people who have embraced the principles set forth in the Constitution of the United States. All residents of this nation are kin in some way by blood or culture to a foreign land. Yet they are primarily and necessarily a part of the new and distinct civilization of the United States. They must, accordingly, be treated at all times as the heirs of the American experiment, and as entitled to all the rights and freedoms guaranteed by the Constitution.”

Dissenting Justice Robert H. Jackson, who later served as Chief US Prosecutor at the Nuremberg Trials, wrote that “Korematsu was born on our soil, of parents born in Japan. The Constitution makes him a citizen of the United States by nativity and a citizen of California by residence. No claim is made that he is not loyal to this country. There is no suggestion that apart from the matter involved here he is not law abiding and well disposed. Korematsu, however, has been convicted of an act not commonly a crime. It consists merely of being present in the state whereof he is a citizen, near the place where he was born, and where all his life he has lived. […] [H]is crime would result, not from anything he did, said, or thought, different than they, but only in that he was born of different racial stock. Now, if any fundamental assumption underlies our system, it is that guilt is personal and not inheritable. Even if all of one’s antecedents had been convicted of treason, the Constitution forbids its penalties to be visited upon him. But here is an attempt to make an otherwise innocent act a crime merely because this prisoner is the son of parents as to whom he had no choice, and belongs to a race from which there is no way to resign.”

After being released from the camp in Utah, Korematsu had to move east since the law would not allow former internees to move back westward. He moved to Salt Lake City, Utah, where he continued to fight racism. He still knew there were inequalities among the Japanese, since he experienced them in his everyday life. He found work repairing water tanks in Salt Lake City, but after three months on the job, he discovered he was being paid half of what his white coworkers were being paid. He told his boss that this was unfair and asked to be paid the same amount, but his boss only threatened to call the police and try to get him arrested just for being Japanese, so he left his job.

In 1976, President Gerald Ford signed a proclamation formally terminating Executive Order 9066 and apologizing for the internment, stated: “We now know what we should have known then—not only was that evacuation wrong but Japanese-Americans were and are loyal Americans. On the battlefield and at home the names of Japanese-Americans have been and continue to be written in history for the sacrifices and the contributions they have made to the well-being and to the security of this, our common Nation.”After this incident, Korematsu lost hope, remaining quiet for over thirty years. His own daughter did not find out about what her father did until she was in high school. He moved to Detroit, Michigan, where his younger brother lived, and where he worked as a draftsman until 1949. He married Kathryn Pearson in Detroit on October 12, 1946. They returned to Oakland to visit his family in 1949 because his mother was ill. They did not intend to stay, but decided to after Kathryn became pregnant with their first child, Karen. His daughter was born in 1950, and a son, Ken, in 1954.

In 1980, President Jimmy Carter appointed a special commission to investigate the internment of Japanese Americans during World War II, which concluded that the decisions to remove those of Japanese ancestry to prison camps occurred because of “race prejudice, war hysteria, and a failure of political leadership”. In 1988, President Ronald Reagan signed the Civil Liberties Act of 1988 which had been sponsored by Representative Norman Mineta and Senator Alan K. Simpson. It provided financial redress of $20,000 for each surviving detainee, totaling $1.2 billion.

In the early 1980s, while researching a book on internment cases, lawyer and University of California, San Diego professor Peter Irons came across evidence that Charles Fahy, the Solicitor General of the United States who argued Korematsu v. United States before the Supreme Court, had deliberately suppressed reports from the Federal Bureau of Investigation and military intelligence which concluded that Japanese-American citizens posed no security risk. These documents revealed that the military had lied to the Supreme Court, and that government lawyers had willingly made false arguments. Irons concluded that the Supreme Court’s decision was invalid since it was based on unsubstantiated assertions, distortions and misrepresentations. Along with a team of lawyers headed by Dale Minami, Irons petitioned for writs of error coram nobis with the federal courts, seeking to overturn Korematsu’s conviction.

On November 10, 1983, Judge Marilyn Hall Patel of U.S. District Court in San Francisco formally vacated the conviction. Korematsu testified before Judge Patel, “I would like to see the government admit that they were wrong and do something about it so this will never happen again to any American citizen of any race, creed, or color.” He also said, “If anyone should do any pardoning, I should be the one pardoning the government for what they did to the Japanese-American people.” Judge Patel’s ruling cleared Korematsu’s name, but was incapable of overturning the Supreme Court’s decision.

President Bill Clinton awarded the Presidential Medal of Freedom, the highest civilian honor in the United States, to Korematsu in 1998, saying, “In the long history of our country’s constant search for justice, some names of ordinary citizens stand for millions of souls: Plessy, Brown, Parks … to that distinguished list, today we add the name of Fred Korematsu.” That year, Korematsu served as the Grand Marshal of San Francisco’s annual Cherry Blossom Festival parade.

A member and Elder of the First Presbyterian Church of Oakland, Korematsu was twice President of the San Leandro Lions Club, and for 15 years a volunteer with Boy Scouts of America, San Francisco Bay Council.

From 2001 until his death in 2005, Korematsu served on the Constitution Project’s bipartisan Liberty and Security Committee. Discussing racial profiling in 2004, he warned, “No one should ever be locked away simply because they share the same race, ethnicity, or religion as a spy or terrorist. If that principle was not learned from the internment of Japanese Americans, then these are very dangerous times for our democracy.”

Fred Korematsu died of respiratory failure at his daughter’s home in Marin County, California, on March 30, 2005. One of the last things Korematsu said was, “I’ll never forget my government treating me like this. And I really hope that this will never happen to anybody else because of the way they look, if they look like the enemy of our country.” He also urged others to “protest, but not with violence, and don’t be afraid to speak up. One person can make a difference, even if it takes forty years.”

In 2018, in Trump v. Hawaii, the Supreme Court expressly declared that Korematsu’s case was wrongly decided. Chief Justice Roberts wrote, “Korematsu was gravely wrong the day it was decided, has been overruled in the court of history, and—to be clear—’has no place in law under the Constitution,” quoting Justice Jackson’s dissent in Korematsu v. United States.

The proclamation by Governor Newsom reads as follows:

“PROCLAMATION: “Fred Korematsu did not set out to become a civil rights hero, but his bold decision at the age of 23 to challenge the policy of Japanese internment forever altered the course of history. This year, as we commemorate the 101st anniversary of his birth, we reflect with gratitude on his brave crusade for civil rights.

An Oakland-born welder, Korematsu refused to abide by Executive Order 9066, the federal government’s demand that Japanese Americans report to incarceration camps. Korematsu’s act of protest led to his arrest and conviction, which he fought all the way to the Supreme Court. The Court ultimately ruled against him, arguing that the incarceration of Japanese Americans was justifiable based on military necessity.

Korematsu found vindication 40 years later, when a federal court overturned his criminal conviction. Judge Marilyn Hall Patel said then, “a grave injustice was done to American citizens and resident aliens of Japanese ancestry who, without individual review or any probative evidence against them, were excluded, removed and detained by the United States during World War II.”

Over the course of his life, Korematsu fought for the civil liberties of others. He was tireless in his work to ensure Americans understood the lessons learned from one of the dark chapters of our history. In 1998, President Bill Clinton awarded Korematsu the Presidential Medal of Freedom.

The Supreme Court’s decision in Korematsu v. United States still hangs over this country after 76 years. Korematsu’s legacy reminds us that we must continue to strike out against injustice in our daily lives.”

Let us celebrate Fred Korematsu Day by learning his story, affirming our rejection of racism, and committing ourselves to stand up for what is right.

 

Irvine Again Ranked No. 1 City in Fiscal Strength!

I am proud to report that the City of Irvine has again — for the 3rd straight year — been ranked as the No. 1 City in the United States in Fiscal Strength by Truth in Accounting (TIA), a nonprofit organization that “cuts through politicization and accounting tricks, presenting transparent and nonpartisan figures of government finances.”

The Truth in Accounting ranking of America’s largest 75 cities calculated how a city would fare financially after all the bills are paid. Irvine was given a surplus score of $4,100 per taxpayer, earning the distinction as the most fiscally healthy large city in the United States.

The key findings of the report regarding Irvine were:

  • Irvine’s Taxpayer Surplus is $4,100, and it received a “B” from TIA. A particular city’s Taxpayer Surplus/Burden is the money available (or needed, if a burden) to pay bills divided by the number of taxpayers.
  • Irvine is a Sunshine City with enough assets to cover its debt. A Sunshine City is a city in state with a taxpayer surplus, which means that the state has enough funds and resources to pay its bills.
  • Decisions by elected officials have created a Taxpayer Surplus, which is each taxpayer’s share of money available after city bills have been paid.
  • Irvine has $626 million of assets available to pay bills.
  • Irvine has $380.4 million available after bills have been paid, which breaks down to $4,100 per taxpayer.

I am extremely proud of these awards, which reflect the strong commitment I’ve made to assuring Irvine’s fiscal health and stability, as well as the commitment of my City Council colleagues and City Staff.

Most important to me is the fact that our City is truly serving its residents with fiscal responsibility and financial transparency.

I ran for City Council on a platform of using my skills as a business attorney to safeguard every public dollar, and I have kept that promise by making sure that Irvine is financially transparent and doesn’t spend more than it can afford.

I have made it my mission to make our City’s budget truly transparent and free from any obfuscations or accounting tricks — and I am tremendously proud that Irvine has received this prestigious non-partisan award as America’s most fiscally healthy city in every year that I have served on the City Council.

Government transparency and fiscal responsibility should be neither a conservative nor a liberal idea, but appeal to both, as we strive to address increasing social needs with limited resources.

The Challenges of Affordable Housing – and How the Irvine Community Land Trust is Making Progress by Opening the Door to a Wave of New Home Owners

As many of you know I am honored to serve as Chair of the Irvine Community Land Trust (ICLT), guiding its mission of providing secure, high-quality affordable housing for the benefit of income-eligible families.

Late last year, we celebrated the groundbreaking for Salerno, our newest affordable housing community in Irvine. On schedule to be completed in the Fall of 2020, Salerno will offer affordable rents as low as $550 for a one-bedroom, $625 for a two-bedroom and $695 for a three-bedroom.

Thirty-five of the homes will be reserved for those earning less than 30 percent of the area median income: 15 for veterans; 10 for individuals with developmental disabilities; and 10 for families at risk of homelessness.  As the Orange County Register observed, these affordable communities offer “a new beginning for veterans, developmentally disabled people and families at risk of homelessness.”

In the video, I talk about the crucial role that ICLT and I played in the passage of new legislation, SB 196, which ICLT and I worked on with Senators Jim Beall, Mike McGuire, and Bob Wieckowski to pass in Sacramento, and which has now been signed into law by the Governor, allows properties slated for affordable rental homes to get a tax exemption sooner, saving nonprofit builders between millions of dollars that can instead go toward building more affordable homes.

The new law also extends this property tax break to land for owner-occupied affordable home projects.  As I told the Orange County Register, “It’s really hard to build these [affordable housing] projects. You have to have a lot of funding, and property taxes can take a significant bite out of that. Even if it didn’t prevent us from doing the [Salerno] project, it lowered the number of units we could do.”  Now that’s been changed.  Under the new law, property tax rates will be lower at the outset for below-market rate, affordable housing, making it much easier and more practical to build more permanently affordable housing for more people in need.

Since I joined the ICLT, we’ve built two below-market rate apartment communities, Parc Derian and Doria, for families making no more than 80 percent of the area’s median household income; some residents earn less than 30 percent of the median income, which in Orange County is $97,900 for a family of four.

The affordable housing we’ve created with ICLT profoundly and positively impacts the health and education outcomes for hundreds of people. That’s why I volunteer to serve as Chair of the Irvine Community Land Trust. The affordable housing crisis isn’t just about buildings. We’re building communities for all the people who desperately need a place to live, including children who need a positive environment to thrive.

Irvine Police Use Drone to Catch Burglary Suspect on Christmas Eve

Last year, I joined three of my colleagues on the Irvine City Council to approve establishing an unmanned aircraft system (UAS) by the Irvine Police Department. The UAS program provides aerial video of active crime scenes, traffic collisions, and natural disasters.

On Tuesday night, December 24, 2019, the Irvine Police Department employed the drone to locate and arrest a commercial burglary suspect at a construction site in the 2900 block of Warner Avenue around 10:20 PM.

Following reports of a burglary in progress, police units arriving on the scene located a self-storage facility under construction and learned that a suspect was inside.

Officers then established a perimeter around the site and made announcements ordering the suspect to surrender.

The suspect hunkered down and was eventually located after police employed a number of resources including a small unmanned aircraft system, commonly referred to as a drone, along with a police helicopter and K-9 to search for the suspect.

A male suspect was located and arrested without incident.

Firefighter paramedics evaluated the man on scene before officers transported him from the location.

No other suspects were believed to be outstanding but officers were nonetheless conducting a protective sweep of the site.

In October 2019, the FBI for the 14th year in a row, named Irvine as America’s Safest City among cities with a population of 250,000 or more.

Help Develop a Strategic Energy Plan for Irvine by Attending a Community Workshop on January 13, 2020

The City of Irvine is developing a Strategic Energy Plan to create a sustainable, economically feasible, and actionable road map for City operations and to identify effective measures the Irvine community can implement to become energy efficient. The objectives of the Plan are to analyze the City’s baseline energy use to project future energy needs, evaluate priorities to meet those needs, and identify funding opportunities to implement the Plan.

The project began in November 2018 and is anticipated to be completed in April 2020. When the Plan is completed, it will be presented to the City Council for consideration and adoption.

Community engagement will help form the vision for the Plan.  As part of the Plan’s development, the City seeks community stakeholder feedback via public workshops, which will be scheduled in the coming months.

The next community workshop on the Strategic Energy Plan will be held on Monday, January 13, 2020 at 5:00 p.m. – 6:30 p.m. at City of Irvine City Hall, 1 Civic Center Plaza, Irvine, California 92606.

At this workshop, City of Irvine staff will present strategies to reduce energy consumption in our energy supply, buildings, and transportation sectors, and guide participants through facilitated discussions on each area.  All residents are invited to ensure that your ideas and feedback are captured as we create the Strategic Energy Plan.

Why I Voted “No” on a Zoning Change to Permit 1,000 More Million Dollar Single Family Houses in Irvine. Tell the Irvine City Council What You Think!

Recently, I voted “No” on continuing the second reading of a re-zoning proposal that would allow the addition of 1,000 single family million dollar houses to be built by the Irvine Company in the area of Portola Springs/Orchard Hills in Irvine.

This vote could have been the end of the issue, since on the first reading both Mayor Christina Shea and Councilmember Mike Carroll voted against the re-zoning.

However, Councilmember Mike Carroll now voted with the supporters of adding 1,000 new homes (Councilmembers Anthony Kuo and Farrah N. Khan) to continue the item to January 2020.

Carroll, Kuo and Khan won the vote to continue, 3-2. This means that these additional 1,000 million dollar single family houses will again come before the Council.

As a longtime advocate for local communities to permit more housing to alleviate our statewide affordable housing crisis, I was initially disposed to vote in favor of this re-zoning proposal.

But on further reflection, it became apparent to me that this proposed housing development would be built without the necessary infrastructure, including new schools and a local retail center, which are needed and have long been promised to residents.

I am a strong advocate for action on the local and state level addressing the housing crisis, but not at the cost of overcrowded schools and the abandonment of Irvine’s renowned village model and our Master Plan balancing housing with schools, retail centers, and open space.

In particular, I am a strong supporter of Irvine’s village concept, which is intended to reduce sprawl and traffic congestion, and create walkable neighborhoods and a sense of community, by locating housing, at several different levels of purchase price or rental cost, around both local schools and a local retail center.  This village model — an essential part of Irvine’s Master Plan long promoted by the Irvine Company — has been enormously successful.  As the Irvine Chamber of Commerce has boasted, Irvine is a “City of Villages.”

For this reason, I was very concerned — shocked, actually — when a representative of the Irvine Company responded to my questioning by stating that the Irvine Company had no plans to build a retail center near these new homes and were no longer committed to the village model.

In other words, I came to see that voting in favor of this zoning change is tantamount to voting for Irvine to no longer be a “City of Villages.”

On the issue of whether these proposed 1,000 million dollar homes would help alleviate the affordable housing crisis, here are the facts:

This week’s OC Register reports on an analysis by the Southern California News Group that graded every jurisdiction in California on its progress on state-mandated housing goals (the Regional Housing Needs Assessment or RHNA).

According to the article, Irvine is supposed to permit 12,149 homes between 2013 and 2021. Housing units are mandated in each of four categories: (1) very low income, (2) low income, (3) moderate income, and (4) above moderate income.

The number show that Irvine has done exceptionally well in providing housing in the moderate and (especially) above moderate income categories, but is not doing nearly as well in the low income and very low income categories, where it is seriously off track in meetings its RHNA goals.

Very Low Income Units: Irvine has permitted 907 very low income units, needs 1,761 to be on track, 2,817 for final goal.  In sum, very low income units are not on track, and are far from the final goal.

Low Income Units: Irvine has permitted 3 units, needs 271 to be on track, 2,034 for final goal. In sum, low income units are not on track, and are far from final goal.

Moderate Income Units: Irvine has permitted 12,973 units, needs 1,399 to be on track, 2,239 for final goal. In sum, moderate income units are more than on track, and are already in excess of the final goal.

Above Moderate Income Units: Irvine has permitted 12,137 units, needs 3,162 to be on track, 5,059 for final goal. In sum, above moderate income units are far more than on track, and are already far in excess of the final goal.

These numbers demonstrate what everyone knows: Irvine’s housing is overwhelmingly skewed toward the “Above Moderate Income” market.

The 1,000 housing units that would be added to Portola Springs/Orchid Hills under the re-zoning proposed by the Irvine Company are single family homes costing above $1,000,000.  These 1,000 “Above Moderate Income” units would not help Irvine meet its Regional Housing Needs Assessment (RHNA) goals.

On the contrary, they would exacerbate Irvine’s school over-crowding and traffic congestion problems while doing little or nothing to ease our affordable housing crisis.

That’s why I voted No.

It is my belief that only saying No to these projects that provide housing only for the well-to-do, will we encourage developers to build more environmentally responsible and affordable housing projects.

I hope Irvine residents will make their views on this proposal for an additional 1,000 million dollar single family houses clear to all members of the Council between now and then.

Join me for Irvine’s 13th Annual Home for the Holidays Pet Adoption Event on Sunday, December 8, 2019, from 10:00 a.m. to 2:00 p.m.  More than 30 pet rescue groups and animal shelters will bring some 600 homeless dogs, cats, rabbits and small animals for adoption.

The Home for the Holidays Pet Adoption Event also features dozens of vendors, gourmet food trucks, a silent auction, low-cost microchipping and an opportunity drawing.

Each animal available for adoption is spayed or neutered, microchipped and evaluated by a veterinarian.  Cats and dogs are vaccinated appropriate to age.

The suggested donation for the event is $2 per person or $5 per family. Parking is free.  Event proceeds benefit the Irvine Animal Care Center in its efforts to provide care and support to thousands of homeless, neglected and abused animals each year.

About the Irvine 2/11 Marine Adoption Committee

The 2nd Battalion, 11th Marine Regiment, 1st Marine Division (2/11) from Camp Pendleton, was officially “adopted” by the City of Irvine at the Irvine Civic Center on September 15, 2007.

The City of Irvine and the 2/11 Marines made a pledge to encourage mutually beneficial interactions between the community and the battalion.

The Irvine 2/11 Marine Adoption Committee, a 501(c)(3) non-profit organization, encourages the community to support our adopted Battalion by participating and donating to a variety of activities, including charitable and educational activities and support, such as holiday and pre-deployment events, care packages, toy drives and more. for the benefit and welfare of the United States Marines and their families.

The 1st Marine Division is oldest, largest and most decorated division in the United States Marine Corps. The 2d Battalion, 11th Marines (2/11) is a 155mm howitzer battalion based at Camp Pendleton, California. Its primary mission is to provide artillery support to the 5th Marine Regiment in time of conflict. At any time, the command has roughly 750 Marines and Sailors assigned to it.

The battalion’s exemplary service ranges from France in World War I to the Battles of Guadalcanal and Okinawa in the Pacific in World War II to Inchon and the Chosin Reservoir in the Korean War to Hue and Phu Bai in Vietnam to Operations Desert Shield and Desert Storm in the Gulf War to Operation Enduring Freedom in Kuwait to the more recent and still-ongoing campaigns in Iraq and Afghanistan.

I am honored to serve as Chair of the Irvine Community Land Trust (ICLT), guiding its mission of providing secure, high-quality affordable housing for the benefit of income-eligible families.  

Since I joined the ICLT, we’ve built two below-market rate apartment communities, Parc Derian and Doria, for families making no more than 80 percent of the area’s median household income; some residents earn less than 30 percent of the median income, which in Orange County is $97,900 for a family of four.

Recently, we celebrated the groundbreaking for Salerno, our newest affordable housing community in Irvine. On schedule to be completed in the Fall of 2020, Salerno will offer affordable rents as low as $550 for a one-bedroom, $625 for a two-bedroom and $695 for a three-bedroom.

Thirty-five of the homes will be reserved for those earning less than 30 percent of the area median income: 15 for veterans; 10 for individuals with developmental disabilities; and 10 for families at risk of homelessness.

As the Orange County Register observed, these affordable communities offer “a new beginning for veterans, developmentally disabled people and families at risk of homelessness.”

New Communities, the first modern land trust, started 50 years ago in Georgia by the descendants of slaves.

As Chair of the Irvine Community Land Trust (ICLT), I have been actively working with members of the California State Legislature to enact tax reforms to make it it much easier to create affordable housing throughout California.

The new legislation, SB 196, which ICLT and I worked on with Senators Jim Beall, Mike McGuire, and Bob Wieckowski to pass in Sacramento, and which has now been signed into law by the Governor, allows properties slated for affordable rental homes to get a tax exemption sooner, saving nonprofit builders between millions of dollars that can instead go toward building more affordable homes.

The new law also extends this property tax break to land for owner-occupied affordable home projects.  As I told the Orange County Register, “It’s really hard to build these [affordable housing] projects. You have to have a lot of funding, and property taxes can take a significant bite out of that. Even if it didn’t prevent us from doing the [Salerno] project, it lowered the number of units we could do.”  Now that’s been changed.  Under the new law, property tax rates will be lower at the outset for below-market rate, affordable housing, making it much more practical to build more housing for more people in need.

Last month, I traveled to Georgia with ICLT Executive Director Mark Asturias and fellow board member Leon M. Napper for the Reclaiming Vacant Properties and Grounded Solutions Conference. While we were there, we visited New Communities, the first of the modern land trusts, founded in Leesburg, Georgia, in 1969, a former plantation is now owned by the descendants of slaves and dedicated to conservation and racial reconciliation. This land trust went on to inspire the hundreds of community land trusts that exist today, ourselves included.

Orange County Fire Authority Press Release on New FIRIS Critical Wildfire Intel Program and Increased Local Staffing During Extreme Red Flag Weather

The Orange County Fire Authority is now using the Fire Integrated Real Time Intelligence System (FIRIS), a 150-day pilot program funded with $4.5 million from a state grant secured by Assemblywoman Cottie Petrie-Norris.

And OCFA Supports Neighboring Fires While Maintain Increased Local Staffing

Irvine, CA – October 29, 2019 – Since being launched nearly two months ago, the new Fire Integrated Real-Time Intelligence System (FIRIS) pilot program aircraft has flown more than a dozen missions and provided enhanced situational awareness to numerous fire agencies. Knowing the fire perimeter and the direction a wind-driven fire is moving has helped decision-makers on the ground determine where to put resources and more importantly which communities to evacuate.

The FIRIS program is fast becoming one of the first air resources requested by Southern California fire agencies when a wildfire breaks out. The ability of the fixed-wing aircraft, equipped with cameras and infrared and radar sensors that can see through smoke, to provide real-time fire perimeter mapping and live high definition video has made a positive difference for incident commanders and decision-makers located in local Command Centers. Data sent from the twin-engine fixed-wing aircraft has also supported the UC San Diego WIFIRE Laboratory that uses its supercomputer to provide a fire spread progression model to be shared with the incident and command center staff.

A partial list of wildfires assisted by FIRIS include: Tenaja –RRU, Ortega-ORC, Palisades-LAF, SaddleRidgeLAF/LAC, Tick, Old, ValVerde-LAC, Kincade-LNU and Getty-LAF.

In addition to the high tech tools being used by the FIRIS pilot program aircraft, Orange County Fire Authority has been supporting its neighbors in Los Angeles with boots on the ground. Currently, four OCFA strike teams are assisting with the Getty Fire. More than 80 firefighters assigned to ten Type 3 brush rigs, and ten Type 1 fire engines are helping to contain the blaze. In addition, the Southern California Edison (SCE) funded night-time hover-filling helitanker and reconnaissance helicopter are also providing support to the Getty Fire. Two of strike teams had previously been assigned to the Tick Fire with the additional two responding upon immediate request of Los Angeles Fire Department.

Neighboring Fires While Maintain Increased Local Staffing

More than a dozen firefighters of various levels, from Division Chief to firefighter, are also providing management and logistics support at the Tick and Kinkade fires.

“Nothing will replace the need for firefighters on the ground battling out of control wildfires. And I appreciate what our men and women do every day,” said Orange County Fire Authority Fire Chief Brian Fennessy. “I am also thankful that through collaboration, the FIRIS technology is helping to make a difference in decision-making which ultimately leads to suppressing wildfires more quickly.”

With critical fire weather predicted through the week, OCFA continues to have increased staffing in order to quickly respond to any wildfire that breaks out in our service territory. More than 100 additional firefighters are ready to respond in a moment’s notice. They’re staffing the following:

  • 10 – Type 1 Fire Engines
  • 5 – Type 3 Brush Rigs
  • 2 – Dozers
  • 3 – Helicopters
  • 2 – Hand Crews
  • 5 – Type 6 Patrols

California State Auditor Gives Irvine Highest Rating for Fiscal Health!

As an Irvine City Councilmember who ran on a promise of fiscal responsibility, I am very pleased to announce that the California State Auditor’s Office has recently published a comprehensive ranking of 471 California cities based on their fiscal health and that Irvine achieved the Auditor’s highest possible rating of “low risk.”

This designation indicates that a city has low risk of experiencing fiscal distress.

Among the indicators used to evaluate the cities’ fiscal health were each city’s cash position or liquidity, debt burden, financial reserves, revenue trends, and ability to pay for employee retirement benefits.

I’m proud of my record on the Irvine City Council in increasing government accountability, openness, and transparency.

I’ve received the Orange County Taxpayers Watchdog Award for “demonstrating dedication to the protection of taxpayer funds and for the advocacy of government transparency and fiscal responsibility.”

Under my leadership, the Irvine Community land Trust was awarded the Platinum Seal of Transparency from GuideStar, the world’s most respected source of information on nonprofit organizations.

I was also the only member of the Irvine City Council to oppose Measure D, which would have eliminated voter input into development decisions, because I believe that citizens must have a strong voice in deciding the future of their neighborhoods.

I enthusiastically supported the City’s adoption of the Irvine Sunshine Ordinance, which expanded public notice to four times longer than California law requires and prevents government action without full and informed participation from the community. I also supported approval of a two-year budget cycle, along with a five-year financial planning program, to bring more accountability to government spending.

As a member of the Irvine City Council, I am extremely proud of these accomplishments But much more important to me is the fact that our city is truly serving its residents with fiscal responsibility and transparency.

I ran for City Council on a platform of using my skills as a business attorney to safeguard every public dollar, and I have kept that promise by making sure that Irvine is financially transparent and doesn’t spend more than it can afford.

These awards reflect the commitment that I and my colleagues on the Irvine City Council, as well as our Finance Commissioners and our professional staff, have made to the taxpayers and residents of Irvine, and to the principles of government transparency and fiscal responsibility.

Government transparency and fiscal responsibility should be neither a conservative nor a liberal idea, but appeal to both, as we strive to address increasing social needs with limited resources.

Irvine Police Department Holding Two Educational Community Meetings on Gun Violence Restraining Orders

I am very pleased to announce that the Irvine Police Department is holding two educational community meetings on Gun Violence Restraining Orders.

A Gun Violence Restraining Order (GVRO) prohibits a person who is a danger to themselves or others from owning, possessing, or receiving any firearms, ammunition, or magazines.

Gun Violence Restraining Order Can Save Lives

A recent study by the U.C. Davis School of Medicine found that California’s red flag law has significantly reduced gun violence.

According to Laura Cutilletta, legal director of the Giffords Law Center, California’s red flag law acts as a sort of timeout, so someone in psychological distress can get counseling while their fitness to possess a gun is evaluated.  “It’s a way to allow for temporary removal of firearms in a situation just like this: where somebody has made threats, where they have been expelled from school because of those threats, they’re in counseling, and parents or the school or whoever it is understands that this person poses a threat,” she explained.

However, the effectiveness of Gun Violence Restraining Orders has been limited by the lack of awareness of the law on the part of both the public and the police.  Too often, neither the public nor the local police are aware of or encouraged to obtain Gun Violence Restraining Orders.

That’s why it is so important that our police department has made these educational workshops on GVROs available to the public.

UCI Named No. 1 College in U.S. for Sustainability. The City of Irvine Should Follow UCI’s Example and Adopt the Community Choice Energy Program and Stand-Alone Climate Action Plan We’ve Been Promised!

Congratulations to the University of California, Irvine (UCI), on being named the No. 1 “Cool School” in the nation by the Sierra Club in its annual ranking of sustainability leaders among U.S. colleges.

UCI is the only university to score in the top 10 for 10 consecutive years.

“As UCI is the only university to have ranked in the top 10 ‘Cool Schools’ for an unprecedented 10 years and counting, we’re continually impressed with its commitment to modeling, teaching and embodying excellent environmental stewardship in all areas,” said Katie O’Reilly, Sierra Magazine’s adventure and lifestyle editor. “The Anteaters are truly standouts in this increasingly important space.”

Colleges were ranked according to which ones offer the best sustainability-focused courses and carbon-neutral land and energy policies, as well as the most opportunities to engage with the environmental movement. UCI was recognized for EV charging stations and converting its central-cooling plant to a system that conserves over 80 million gallons of potable water per year while cooling campus buildings —17 of which are certified LEED Platinum and seven of which are zero-waste facilities. UCI also was recognized for creating a new pilot project to provide free insulation retrofits and solar installations in nearby low-income communities.  In addition, UCI researchers were recognized for their work in  adapting medical and public health curricula to better prepare students to treat tropical diseases as they expand in range due to climate change.

The City of Irvine has a lot to learn from UCI’s accomplishments.

Under Irvine Mayors Larry Agran, Beth Krom and Sukhee Kang, Irvine was indeed a world leader in environmental programs and innovation. One of the highlights of Irvine’s environmental engagement was presence of the U.S. Solar Decathlon at the Orange County Great Park in Irvine. The Solar Decathlon is an international competition held every two years that challenges collegiate teams to design, build, and operate solar-powered houses that are cost-effective, energy-efficient, and attractive. The houses are assembled at a central location for display, evaluation, and awards. The winner of the competition is the team that best blends affordability, consumer appeal, and design excellence with optimal energy production and maximum efficiency. The Solar Decathlon was held at the Great Park in 2013 and 2015.

Another highlight of Irvine’s environmental leadership was the creation of the Green Ribbon Environmental Committee in 2012.  The Green Ribbon Committee was charged with the crucial task of developing and recommending environmental policy initiatives and programs, including sustainability policies related to energy, recycling and waste management, mobility, open space and water issues.

Unfortunately, when Steven Choi became mayor of Irvine in November 2014, both the Great Park Solar Decathlon and the Green Ribbon Committee became victims of Choi’s climate change denial and hostility to environmental action.

As I’ve detailed in How Orange County Lost the U.S. Solar Decathlon, Steven Choi was hostile to the very premises of the Solar Decathlon — the need for replacing burning fossil fuels with renewable sources of energy.  In sharp contrast to the previous three Irvine mayors who championed environmental and climate concerns, Choi “completely question[ed] the idea of global warming being caused by human intervention.”  Rather than recognizing the importance of environmental action,  both as an opportunity for technological innovation and as an existential imperative, Choi saw all environmental concerns as anti-business and climate change as wholly unconnected to human activity. You can read the full story of the Solar Decathlon here.

Similarly, Choi sabotaged the Green Ribbon Environmental Committee. In fact, when I was elected to the Irvine City Council in November 2016, the Irvine Green Ribbon Environmental Committee had been inoperative for several years because Mayor Steven Choi and his allies on the Irvine City Council did not appoint sufficient members to constitute a quorum. In fact, the Committee did not meet during all of 2014 and 2016, cancelling every scheduled meeting. The words “climate change” and “global warming” were not permitted to be used in official City of Irvine publications or staff reports. Choi didn’t even allow the City of Irvine to participate in the Annual National Mayor’s Challenge for Water Conservation, sponsored by the Irvine-based Wyland Foundation.

As a longtime environmental activist, I wasn’t going to allow the City of Irvine to continue to ignore environmental issues and global warming. I convinced newly elected Mayor Donald P. Wagner, who replaced Steven Choi, to re-invigorate the Green Ribbon Environmental Committee and appoint me to the Committee as the City Council’s representative.  I then appointed Krishna Hammond, a young progressive scientist, as my representative to the Committee and encouraged the other Councilmembers to make appointments.  At our first meeting, I was elected Chair of the Committee and Krishna was elected Vice Chair.  The Green Ribbon Environmental Committee was out of Choi-imposed exile and was off and running.

I am extremely proud of the work we’ve done and the things we’ve accomplished since then.

Perhaps most important, we commissioned a study of Community Choice Energy (CCE) and then recommended that the City Council follow its recommendation to implement a CCE plan with an expected savings of $7.7 million per year in citywide electricity cost savings for Irvine residents and businesses, and a $112,000 per year savings for the City itself in municipal energy costs, as well as driving additional local economic development benefits, such as new jobs and $10 million in annual economic output. 

Now I am concerned that the work we’ve done on CCE is about to be undermined by the current City Council leadership.  I have learned that CCE advocates have been getting “push back” from the City and the City Manager.

The Green Ribbon Committee also recommended swift adoption of a stand-alone Climate Action Plan, so that, in the words of climate activist Robin Raeder Ganahl, “Irvine residents know what the City’s plan is to reduce emissions, meet state targets, and protect our quality of life.” Again, I am now concerned that the current City Council leadership has no intention of adopting a stand-alone Climate Action Plan, and is simply sitting on the Green Ribbon Committee’s recommendation with no intention to move forward.

We’ve made progress since the days when Steven Choi drove the U.S. Solar Decathlon out of town, shut down the Green Ribbon Environmental Committee, refused to participate in the Wyland Foundation’s Water Challenge, and banned the words “climate change” and “global warning.”

But there is still much to be done. In particular, the current Irvine City Council leadership needs to show that its professed concern for action on climate change and protecting the environment isn’t just lip service and a public relations smokescreen.

Instead, the City Council needs to adopt a stand-alone Climate Action Plan that we’ve been promised and implement the Community Choice Energy program that we’ve shown to be a tremendous benefit to both the City and the planet. 

 

Show Your Support for a Great Park Botanical Gardens at our Board Meeting on Tues., October 22, 2019!

If you’re a supporter of botanical gardens in the Orange County Great Park, please attend the important Great Park Board Meeting on Tues., October 22, 2019, at 1:00 p.m. in the Irvine City Council Chambers.

This meeting is scheduled to include a development status update and accounting of projects currently proposed in the Orange County Great Park.

Of special concern to supporters of Great Park Botanical Gardens is the fact that there is no funding or acreage currently allotted or proposed for a botanical gardens.

It is crucial that supporters of a Great Park Botanical Gardens show up to the meeting and make your voices heard!

I have long been a strong advocate for botanical gardens and museums in the Great Park’s Cultural Terrace.  Every survey we’ve done has shown that gardens are among amenities that people most want in the Great Park. The Orange County Register reported that “Gardens were among the most popular features in the surveys, according to the city staff report. Eighty-two percent of Orange County residents said they are at least somewhat interested in having botanical gardens at the Great Park, when they were asked specifically about the feature.”

I agree with the Great Park Garden Coalition that “We need places where children can experience nature and explore, where all can find refuge from the ever-increasing urban density and traffic, where people of all ages and abilities can experience beautiful outdoor spaces. All great urban parks have great garden spaces: Golden Gate Park, Central Park, Balboa Park.”

I also continue to agree with what Joyce Mann wrote in the Voice of OC in 2017: “Gardens are an inclusive, a-political opportunity to bring community together for generations. They are a public benefit that becomes a lasting legacy. Besides being beautiful to look at, education is fundamental to the mission of botanical gardens. Through them, we have an opportunity to teach students of all ages about developing environmental awareness and to learn about plant science, gardening and the ecology of our local forests, rivers and wetlands. Botanical gardens become a living plant museum that will inform visitors about the importance and often-irreplaceable value of plants to the well-being of humans and to the earth’s fragile ecosystems. Isn’t that the very definition of a legacy?”

My top priorities for the Great Park Cultural Terrace are a world-class Botanical Gardens and a California Natural History Museum. I want them moving forward without any more unnecessary delays or unnecessary layers of bureaucracy. I will continue to fight for them until they are a reality.

I appreciate that gardens and museums are not necessarily revenue-producing amenities. But as reported in OC Weekly, “Great Park Director/City Councilwoman Melissa Fox said that, ‘I will also insist that we follow the recommendations of residents and build world-class botanical gardens, museums and a lake to make Irvine the home of a truly Great Park.’ But most heartening, on May 22, Fox pushed back on the notion that everything in the Cultural Terrace must generate a lot of revenue. ‘The Cultural Terrace is the Cultural Terrace,’ she told Irvine planners and consultants at the Great Park board meeting. ‘Not the Commercial Terrace.'”

The new law provides a property tax exemption for developers of affordable housing during the construction phase—the first three to five years after purchasing raw land. The legislation is expected to go a long way in fueling more affordable housing development.”

Many people understand that the cost of land and housing is very expensive in Orange County, and in our world, we can’t carry the cost of market-rate land. Because most of our land is developed through a public partnership, we hoped to get this in place to use money to pay for the construction of new projects.'”

“Asturias anticipates that the legislation will be successful in generating more affordable housing, which the state of California desperately needs. ‘This is a wonderful opportunity for us. We are now going to be able to develop properties without paying taxes on the property at market rate while we are trying to get our entitlements in place,’ Asturias. ‘In California, it takes three to five years to get through the process from the day you buy the property to the day you can actually finish the construction of the house.'”

“The legislation does come with a caveat. Developers must start and complete their project on time, or they must pay back the taxes. ‘We talked with many people in the community land trust about how long we would need to develop vacant land. It is usually three to five years,’ Asturias says. “We didn’t want to represent to anyone as we were getting this bill put forward that we were land banking, meaning that we were going to hold vacant land and not develop it. That isn’t the mission of a community land trust, and we felt that was reasonable to put a limit on the amount of time that the exemption could be in place. That was a fair trade-off in our view.'”

“The state and Governor’s office is on a mission to combat the housing crisis, and this is only the latest piece of legislation. ‘We want to demonstrate that we can offer a variety of tools, and we believe that the Governor recognized that,’ says Asturias. ‘With all of the legislation that he is passing, we believe that he is demonstrating an effort to address the entire housing spectrum.’”

Our next affordable housing community for the Irvine Community Land Trust is 68 owner-occupied townhomes on Native Spring alongside the 133 toll road.  The ILCLT  has been under contract to buy the land from the city for four and a half years, but has held off closing escrow until the new legislation is in place, saving an estimated $600,000 in property taxes.  Now we are able to move forward immediately on this innovative and exciting project in affordable home ownership!

Designated OCFA Fire Stations will be hosting Open Houses for the public from 10:00 am to 1:00 pm on Saturday, October 12, 2019.

OCFA’s station Open Houses will give visitors an opportunity to meet and greet their neighborhood firefighters, tour their local fire stations, and hear about ways they can stay fire safe.

It will also be a great opportunity to thank your firefighters for their everyday heroism and tell them that you appreciate their bravery and professionalism!

We Just Opened a New Affordable Housing Community in Irvine and Made it Easier to Create Affordable Housing Throughout California!

I am honored to serve as Chair of the Irvine Community Land Trust (ICLT), guiding its mission of providing secure, high-quality affordable housing for the benefit of income-eligible families.  Like all Irvine Community Land Trust Board Members, I serve as a volunteer, without compensation.  

Since I joined the ICLT, we’ve built two below-market rate apartment communities, Parc Derian and Doria, for families making no more than 80 percent of the area’s median household income; some residents earn less than 30 percent of the median income, which in Orange County is $97,900 for a family of four.

Last week, we celebrated the groundbreaking for Salerno, our newest affordable housing community in Irvine.

On schedule to be completed in the Fall of 2020, Salerno will offer affordable rents as low as $550 for a one-bedroom, $625 for a two-bedroom and $695 for a three-bedroom. Thirty-five of the homes will be reserved for those earning less than 30 percent of the area median income: 15 for veterans; 10 for individuals with developmental disabilities; and 10 for families at risk of homelessness.

As the Orange County Register observed, this affordable community will be “a new beginning for the veterans, developmentally disabled people and families at risk of homelessness who will become its tenants when it opens next year.”

In addition, I’m excited to report on the passage of new tax break legislation I’ve been fighting for in Sacramento, which will make it much easier to create affordable housing throughout California! 

The new legislation, which I worked on with Senators Jim Beall, Mike McGuire and Bob Wieckowski to pass in Sacramento, allows properties slated for affordable rental homes to get a tax exemption sooner, saving nonprofit builders between millions of dollars that can instead go toward building more affordable homes. The new law also extends this property tax break to land for owner-occupied affordable home projects.

As I told the Orange County Register, “It’s really hard to build these [affordable housing] projects. You have to have a lot of funding, and property taxes can take a significant bite out of that. Even if it didn’t prevent us from doing the [Salerno] project, it lowered the number of units we could do.”

Now that’s been changed.

Before the new legislation, property taxes were not adequately adjusted for below-market rate housing.  Landowners such as the ICLT that wanted to build affordable, below-market housing couldn’t get a property tax exemption until a project was underway, and county tax assessors interpreted that requirement to mean anything from shovels in the ground to tenants moving in.  In the case of Salerno in Irvine, where vacant land is assessed at approximately $4 million an acre, taxes on the land amounted to $275,000, which had to be paid before the project could be constructed.

Under the new law, property tax rates will be lower at the outset for below-market rate, affordable housing, making it much more practical to build more housing for more people in need.

Join Us on Thursday, September 19, at 5:30–6:30 p.m. for Public Outreach on the Universal Playground Project at Sweet Shade Neighborhood Park!

Please join us on Thursday, September 19, at 5:30–6:30 p.m. for the City’s public outreach opportunity regarding the Sweet Shade Ability Center at Sweet Shade Neighborhood Park. 

This event is the public’s first opportunity to provide input that will help guide the planning and design for this important Universal Playground project.

In July 2019, the City’s Disability Services program relocated its offices from City Hall to Sweet Shade Neighborhood Park. As a renovated facility, the Sweet Shade Ability Center provides a larger, more accessible, and inviting hub for the delivery of Disability Services activities to Irvine residents. To complement this use, the City proposes to develop the City’s first Universal Playground.

Universal playgrounds are designed to be usable by all people to the greatest extent possible without the need for adaptation or specialized design, including theme-oriented playground equipment, site furnishings, and shade canopies that are well integrated with the existing park, leaving no child on the sidelines.

This public outreach event will include a staff-led tour of the existing playground and potential locations for integrating universal play elements or developing an adjacent universal playground. Planning staff will be present to answer questions about the project, and participants will be able to sign up and receive project updates.

Universal Playgrounds are designed to provide inclusive and meaningful play experiences for children of all ages and abilities. Your input will help the City of Irvine create a unique and meaningful play environment that meets universal developmental needs by providing opportunities for physical, cognitive, communicative, social/emotional, and sensory development for all children to the greatest extent possible.

I’m excited to join Irvine Community Services Commission Chair Lauren Johnson-Norris and other City officials who have been working for all of Irvine’s children at this important event.

We build high-quality affordable rental, ownership and special needs housing for the benefit of income-eligible families. Located in the heart of Southern California’s one of the most expensive real estate markets, there is a tremendous need for affordable housing.

Because this is our home, too, the we are committed to ensuring that Irvine is a place where everyone can call “home.”

On Thursday, Sept. 19, at 10:00 a.m., we’ll be hosting a groundbreaking ceremony for our latest project — the 80-unit Salerno.

You are invited to attend!

Join Me at OCFA’s “Day of Remembrance” Ceremony Honoring Those We Lost on September 11, 2001

Please join me, the brave men and women of the Orange County Fire Authority (OCFA), and other members of the OCFA Board of Directors at a special “Day of Remembrance” Ceremony at OCFA Headquarters in Irvine, honoring those lost on September 11, 2001.

The ceremony will take place at 8:46 a.m. and is in memory of all of those lost at the World Trade Center, the Pentagon, and in Shanksville, Pennsylvania.

Here is the official announcement of the ceremony:

“The tragic events of September 11, 2001 that occurred is a day in our nation’s history that we can never forget. On Wed., Sept. 11, 2019, the Orange County Fire Authority (OCFA) is commemorating the 18th anniversary of the horrific attacks of 9/11. Marking this important anniversary, OCFA will host the annual Remembrance Ceremony to honor the 2,977 men, women and children killed in the attacks at the World Trade Center site, the Pentagon, and aboard Flight 93. This year’s 18th anniversary is especially important to OCFA as we will dedicate a beam from the Twin Towers at our Regional Fire Operations Training Center (RFOTC).”

Never forget.

Defend Democracy. Tell the Irvine City Council: These are the Public’s Meetings!

City Councils are not private clubs. Public meetings in a real democracy should not be stage-managed by the political majority to prevent public discussion of issues that they want to avoid for their own political advantage.

Last July, while I was on a long-planned vacation to visit my son in Alaska, the Irvine City Council adopted a new anti-democratic policy that prohibits an item from being placed on the agenda unless the mayor or two city council members agree to do so.

As the Orange County Register correctly stated in a powerful editorial opposing the Council’s action, “the transparent goal is to shut down the views of the political minority.”

The new policy was in direct response to my proposal in June to fly the Gay Pride Flag from City Hall during Gay Pride Month. Although dozens of residents spoke at the meeting in support of flying the Pride Flag, the Council defeated the proposal and I was the only Councilmember to speak in favor of it.

In opposing this restrictive and anti-democratic agenda policy, the Register observed that “Public-meetings laws have a vital purpose in a free society. The public is supposed to be privy to the inner workings of government so they can witness the sausage-making legislative process in action, ugly and unappetizing as it can be. Unfortunately, many local officials act as if hearings are a show – a way to put their best foot forward before the citizenry.”

The Register also recognized that while the new rule was adopted specifically to silence me, the effect of the rule will be to silence all disagreement and dissent:

“Fox has previously discussed supposedly ‘divisive’ issues ranging from flying the LGBTQ flag at City Hall to creating a veterans’ cemetery near the Great Park. But this fracas isn’t about the particular issues any member might want to discuss, but about whether a duly elected official has the right to publicly discuss them. Councils are not private clubs . . . These are the public’s meetings and all officials, even minority voices, represent their constituencies. All elected bodies need to encourage wide-ranging discussions so the public can be part of the self-government process – and not just observers of a carefully crafted script. That’s the essence of representative democracy.”

At this Tuesday’s Irvine City Council meeting, the political majority will propose to extend this anti-democratic policy to the Great Park Board (composed of the members of the Irvine City Council) as well as to all City Commissions.

The public should not tolerate this extension of the current majority’s attack on representative democracy.

Please attend the Tuesday, September 10, 2019, Irvine City Council meeting and let them know that your City Council is not a private club. The meetings of the City Council, the Orange County Great Park, and Irvine City Commissions belong to the public and cannot be staged managed for political advantage. 

As the O.C. Register eloquently stated, “These are the public’s meetings and all officials, even minority voices, represent their constituencies. All elected bodies need to encourage wide-ranging discussions so the public can be part of the self-government process – and not just observers of a carefully crafted script. That’s the essence of representative democracy.”

As I stated in July, I have no intention of being silent.

And neither do you.
