Tell the Irvine City Council to Agendize the Proposal to Educate Residents and Law Enforcement about California’s Red Flag Law and Gun Violence Restraining Orders

California has a “red flag law” that allows family members or police to seek a court order to temporarily remove guns from mentally unstable people, but too few are aware of it. I have asked the mayor to place my proposal that Irvine educate our residents and police about California’s red flag law and its appropriate use on the City Council agenda. 

Here is the memo that I sent to the mayor:

“​Re: Reducing Gun Violence and California’s Red Flag Law

After the May 2014 mass shooting in Isla Vista in which a mentally unstable young man killed six people and injured fourteen others before killing himself, California passed a ‘red flag law’ that empowers family members and law enforcement officers to petition a court to obtain a “Gun Violence Restraining Order” (GVRO) to temporarily limit a person’s access to guns if they are an immediate and present danger of harming themselves or others.

Red flags laws have now been passed in 17 states and several more states are considering such laws. Red flag laws have been supported by both Republicans and Democrats. In the aftermath of the recent mass shootings in Dayton and El Paso, President Trump declared that ‘We must make sure that those judged to pose a grave risk to public safety do not have access to firearms and that if they do, those firearms can be taken through rapid due process. . . That is why I have called for red flag laws, also known as extreme risk protection orders.’

Red flag laws are not just meant to prevent mass shootings. September is Suicide Prevention Awareness Month. Nearly two-thirds of the gun deaths in the United States — over 22,000 per year — are suicides. Eighty-three percent of suicide attempts by gun succeed; suicide attempts by other means are fatal only 5% of the time. A GRVO can save lives by temporarily preventing a loved one from accessing the most lethal form of suicide until the crisis passes, giving them a chance to get the help they need.

But for red flag laws to be effective, it is important that members of the public and local police officers are aware of the law and encouraged to obtain Gun Violence Restraining Orders when appropriate. Unfortunately, awareness of our red flag law is not nearly as widespread as it should be.

​I am proposing that the Irvine City Council work with City Staff and the Irvine Police Department to devise and implement a public awareness program regarding California’s red flag law, hold training sessions on the red flag law for members of the Irvine Police Department, and direct our law enforcement officers to use GVRO’s when appropriate.

I am requesting that this item be placed on the agenda for the Irvine City Council.”

Due to the City Council’s new restrictive agenda policy, which prohibits an item from being placed on the agenda unless the mayor or two city council members agree to do so, I can not place this item on the agenda without the support of the mayor or other councilmembers.  Accordingly, I have asked Irvine Mayor Christina Shea to agree to put this proposal on the Irvine City Council agenda.

Red flag laws save lives.

A recent study by the U.C. Davis School of Medicine found that California’s red flag law has significantly reduced gun violence. According to Laura Cutilletta, legal director of the Giffords Law Center, California’s red flag law acts as a sort of timeout, so someone in psychological distress can get counseling while their fitness to possess a gun is evaluated.  “It’s a way to allow for temporary removal of firearms in a situation just like this: where somebody has made threats, where they have been expelled from school because of those threats, they’re in counseling, and parents or the school or whoever it is understands that this person poses a threat,” she explained.

OC Sheriff’s deputies in Mission Viejo successfully petitioned the court for a Gun Violence Restraining Order and temporarily removed over 22 firearms and 3,000 rounds of ammunition from the home. All the firearms were legally obtained by the suspect who was arrested for domestic violence.

However, the effectiveness of the red flag law has been limited by the lack of awareness of the law on the part of both the public and the police.  Too often, neither the public nor the local police are aware of or encouraged to obtain Gun Violence Restraining Orders.

A national organization, Speak for Safety, has formed for the specific purpose of raising awareness of the Gun Violence Restraining Order as a tool to remove firearms and ammunition from people who are an immediate danger to themselves or others.

Recently, deputies from the Orange County Sheriff’s Department  a domestic violence victim in Mission Viejo who feared for her family’s safety. Deputies petitioned the courts for a Gun Violence Restraining Order and an Emergency Protective Order. They temporarily removed over 22 firearms and 3,000 rounds of ammunition from the home. All the firearms were legally obtained by the suspect who was arrested for domestic violence.

But too often, neither family members nor law enforcement personnel know that such a gun violence prevention tool exists, even in states, like California, that have very effective GVRO laws on the books.

This the reason I have proposed  that the Irvine City Council work with City Staff and the Irvine Police Department to devise and implement a public awareness and education program regarding California’s red flag law, hold training sessions on the red flag law for members of the Irvine Police Department, and direct our law enforcement officers to use GVROs whenever appropriate.

Please join me in this effort by contacting the Mayor and the Irvine City Council and urging them to support this common sense proposal to use California’s existing red flag law to prevent gun violence and save lives in Irvine.

Irvine Community Land Trust Receives “No Place Like Home” Award from Families Forward!

As Chair of the Irvine Community Land Trust (ICLT), I’m proud to announce that we have been honored with the “No Place Like Home” award during the 8th Annual Housing Partner Appreciation Event hosted by Families Forward.

ICLT’s Parc Derian, which provided 80 new units of housing for working families, veterans, and special-needs residents of Irvine, was celebrated for providing access to stabilized housing for qualifying low-income families.

Located in the Irvine Business Complex and developed on a 2.2- acre urban infill site, Parc Derian beautiful multifamily four-story community with a pool, tot lot, private parking, exercise center, computer lab, and onsite resident services. Featuring contemporary architecture that incorporates urban inspired elements and finishes, it is also environmentally conscious and designed to achieve a LEED Gold certification.

Intended to bring employees closer to work, it is a short walk to many jobs as well as Irvine Unified Schools, public transportation, dining and shopping options. Apartments range from one- to three bedrooms and include walk-in closets, energy-efficient appliances, assigned parking and balconies.

Parc Derian is the result of a public/private partnership between the Irvine Community Land Trust, C&C Development, Innovative Housing Opportunities (IHO), Lennar Corporation, and the City of Irvine.

Finding solutions to the housing and homelessness crisis has been a priority for me, both as a member of the Irvine City Council and as Chair of the Irvine Community Land Trust.  Irvine has been a model in this area and the Land Trust concept, now being adopted by Orange County and many other cities, is something that Irvine has pioneered.  No other city has a Land Trust like we have, and other cities are working to copy ours.

As ICLT Executive Director Mark Asturias has stated, “Parc Derian is an excellent example of public-private partnerships working creatively to provide affordable housing for Irvine’s workforce. Every family and individual deserves the ability to afford a home in their community. Parc Derian is a tremendous accomplishment for all the partners involved and for the Irvine community. It demonstrates how a city can partner with a home-grown nonprofit such as the Land Trust and developers to bring permanently affordable housing into the community. By providing homes people can afford, they commute less, spend more time with their family, and give back to the community they live in. Irvine is stronger with affordable housing.”

Nonprofit organizations like the Irvine Community Land Trust that work to create more affordable housing are often under attack from NIMBY groups.  That’s one of the reasons why I’m so delighted to see our work recognized by those whose mission is to provide affordable housing for those in need.

I look forward to working with the Irvine Community Land Trust, community partners such as Families Forward, and community-minded businesses in the private sector to continue to provide more permanent, affordable housing for veterans, disabled persons, and working families.

I’m Honored to be Featured in Orange County Firefighter Magazine on the New Fire Museum in the Great Park!

As a long-time advocate for the California Fire Museum and Safety Learning Center, and for preserving the heritage of our California firefighters in a permanent facility in the Great Park, I’m honored to be featured in the Summer 2019 issue of Orange County Firefighter, the official publication of the Orange County Fire Services Association, in an article highlighting Irvine’s agreement to designate 5 acres of the Great Park as the new home of the California Fire Museum – Safety Learning Center.

I’m excited to see recognition of the importance of fire safety and for preserving and celebrating our California firefighter heritage!

The mission of the California Fire Museum is:

  • To preserve and protect the history and heritage of the fire service in general, with special emphasis on the California Fire Services.
  • To collect, restore, preserve and exhibit apparatus, equipment, art and artifacts of the firefighting profession.
  • To provide life safety, fire safety and fire prevention education to the community.
  • To educate the public about firefighters, firefighting and emergency services.

Let’s Reduce Gun Violence By Educating the Public and Training Our Police to Use California’s “Red Flag” Law

California has some of the country’s strictest gun control laws; these laws are likely the reason that California has one of the lowest overall gun deaths per capita in the nation.

Yet, as the recent mass shooting in Gilroy shows, our state laws are not enough, by themselves, to prevent our residents from becoming victims of gun violence. In order to better protect our residents in California from gun violence, two more crucial steps need to be taken.

One of these steps — and by far the most important — is that Federal gun regulations must catch-up to California’s. 

The assault rifle used in the mass shooting in Gilroy is banned in California, but it is legal in our neighboring state of Nevada, where it was legally bought by the killer three weeks before the shooting.

The killer also had several high capacity magazines for the weapon, which are also illegal in California, but not in Nevada where they were bought.

Until the federal government finds the courage to defy the NRA and the gun dealer lobby, it will be very difficult to prevent these weapons of war from other states from being brought into and used in California.

For this reason, national action on gun violence should be advocated by everyone in California who cares about reducing gun violence.  Politicians who support the current president’s policy of giving veto power over federal gun regulations to the gun dealer lobby are undermining the effectiveness of California’s gun laws. For California to be safe, assault rifles and large capacity magazines must be outlawed in all of the states.

But another important step can be taken now, by us, even at the local level. That step is to inform and educate the public — and train our police officers — on the effective use of California’s gun regulations that are already on the books.

Perhaps the most important of these gun regulations is California’s “red flag” law, which empowers family members and law enforcement officers to petition courts to obtain a “Gun Violence Restraining Order” (GVRO) to temporarily limit a person’s access to guns if they are an “immediate and present danger” of harming themselves or others.

In 2014, California became the first state to let family members ask a judge to remove firearms from a relative who appears to pose a threat.  The “Gun Violence Restraining Order” law (California Penal Code Section 18100 et sec), modeled after domestic violence restraining orders, allows police or family members to obtain a judge’s order to disarm a gun owner they fear will turn violent. The order requires the gun owner to surrender all firearms for 21 days, and can be extended to a full year after a hearing.

The California legislature took action after a mentally ill man killed six students and wounded 13 others near the University of California, Santa Barbara, before killing himself. Authorities were legally unable to confiscate the weapons of the killer, despite his family’s having expressed concerns to authorities that he would become violent.

California’s law also empowers police to petition for the protective orders, which can require authorities to remove firearms for up to one year. Fifteen states and the District of Columbia have since adopted similar laws.

San Diego is an exception.  Since 2017, San Diego County has issued more than 300 orders, more than any other county in the state. They have been used to intervene in escalating cases of domestic violence, to prevent potential suicides, and with people with potentially dangerous mental illness. In the end, the police have seized more than 400 weapons and nearly 80,000 rounds of ammunition. As San Diego City Attorney Mara Elliott has stated, ““We have no problem with responsible people having guns,” she said. “Our concern are the people who are no longer responsible. That’s when we’ll step in.”

The San Diego City Attorney’s office has been given a grant by the State of California to provide this training.  According to the San Diego City Attorney’s office, “Using case studies, we explain ways to apply the law, describe the process for obtaining a GVRO, and address complex issues concerning domestic violence, juveniles and individuals with neurological disorders, including dementia and Alzheimer’s. We also devote a significant amount of time to the topics of service, search warrants and seizure (firearms). The curriculum is directed at those responsible for implementing and coordinating a GVRO program at their agencies. Typically, all forms of law enforcement and city attorneys, with law enforcement clients, would directly benefit from this event. We have received nothing but positive feedback, increased interest and requests for more training from the law enforcement agencies and city attorneys we have worked with so far.”

I believe that Irvine should also be a leader in utilizing the common sense gun control regulations that are already on the books.

Therefore, I will propose that the Irvine City Council work with City Staff and the Irvine Police Department to devise and implement a public awareness and education program regarding California’s red flag law, hold training sessions on the red flag law for members of the Irvine Police Department, and direct our law enforcement officers to use GVROs whenever appropriate.  We should contact both the San Diego City Attorney’s Office and the State of California about providing us with assistance with red flag training, procedures, and protocols.

Please join me in this effort by contacting the Mayor and the Irvine City Council and urging them to support this common sense proposal to use California’s existing red flag law to prevent gun violence and save lives in Irvine.

Everyone who knows someone who may be at risk of hurting themselves or others with a gun, should know how to “Speak for Safety” with a GVRO.

Watch Orange County Fire Authority Chief Brian Fennessy on Leadership: “Building a Mission-Driven Culture”

One of the accomplishments I’m most proud of as a public official is advocating as a member of the board of directors of the Orange County Fire Authority (OCFA) for the selection of Brian Fennessy as our new Fire Chief.

OCFA Chief Brian Fennessy is one of the nation’s most respected leaders in the crucial field of emergency management.

Recently, Fire Chief Fennessy was invited by the Federal Emergency Management Agency (FEMA) to present his perspective on emergency management leadership to a national audience.

In his talk, titled “Building a Mission-Driven Culture,” Chief Fennessy shares the values of a mission-driven culture and the importance of intent-based leadership in emergency management.

Chief Fennessy also discusses his path to leadership and why he firmly believes that a mission-driven culture is critical to organizational success in times of chaos and during daily operations.

All of us involved in emergency response and management — first responders, public officials, citizen volunteers — will benefit from the wisdom and experience of OCFA Chief Brian Fennessy in this extremely timely talk.

Use the Safest Route to School . . . and other Safety Tips for the New School Year!

Irvine is proud of its outstanding public schools and its long-standing reputation as America’s safest city — so we’re very pleased to help students get to school in the safest possible way along the safest route.

Take a look at the Suggested Routes to School put together by our Irvine Department of Transportation.

You’ll be able to find the best and safest route to your child’s school.

These routes are intended for children who walk or ride bicycles to school. We strongly encourage you to review the plan with your child and, if possible, walk the route to make sure he/she understands the route.

In addition, our Irvine Police Department has several tips to help you and your children get to and from school safely each day.

Here are some tips to keep in mind:

  • Leave early. The first couple of weeks of school bring heavier traffic. You won’t have to rush if you plan for a little extra time.
  • Obey all traffic laws and signs in school zones.
  • Drop children off in the designated locations. Do not allow children to get out of the car in the middle of the street.
  • Remember that everyone has the same goal of getting their children to school safely, so be patient with other drivers and pedestrians.
  • Always obey crossing guards.
  • Always use crosswalks.
  • Do not engage in distracted driving. This is especially dangerous in school zones.
  • Our Traffic officers patrol the streets near school to ensure safety. Remember to slow down and make complete stops at stop signs.

Irvine’s Kids Need You! City of Irvine Seeks Applicants for Four Positions on Child Care Committee!

The Irvine Community Services Commission is accepting applications to fill two government, civic, or community agencies vacancies, and two child care provider vacancies on the Irvine Child Care Committee.

There is a serious child care crisis in Irvine.  At present, nearly 2,500 Irvine families do not have adequate child care. Irvine will need an additional 4,551 child care spaces by 2035, due to the increase in housing development and the concomitant increase in the number of families with young children moving to Irvine.

As a member of the Irvine City Council, I have made it a priority to increase childcare and early childhood education opportunities in Irvine. By volunteering to serve on the Irvine Child Care Committee, you can serve our community and help me and others work to alleviate our childcare crisis.

The Irvine Child Care Committee is a 15-member advisory body to the Irvine Community Services Commission, and works cooperatively with the Irvine Children, Youth, and Families Advisory Committee, Child Care Coordination staff, and Community Development to enhance the quality of childcare and school readiness in the City of Irvine.

The Irvine Child Care Committee acts in an advisory capacity to the Community Services Commission, providing input on the needs of the community pertaining to child care-related issues. The full committee includes five City Council appointees; two center- or home-based child care providers; two parents/guardians; three representatives, one each from Irvine Unified School District, University of California Irvine, and Irvine Valley College; and two community representatives.

Committee meetings  are held on the second Tuesday of January, March, May, September, October and November, from 9:00 am to 10:30 am at Heritage Park Community Center, or other designated Irvine location.

Applicants must be willing to commit to a two-year term of active service, January 2020 through December 2021. Irvine Child Care Committee meetings are held the second Tuesday of select months (at least six times a year) from 9 to 10:30 a.m. at Heritage Park Community Center or other Irvine locations.

Applications are available now at the Irvine Child Resource Center and Irvine Civic Center, and online at cityofirvine.org/childcare. Yes, Let’s Create a Gun Violence Task Force — And Let’s Also Have a Real Discussion about How to Prevent Mass Shootings and Gun Violence

Based on her recent social media post, it appears that in the wake of three recent mass shootings (in Gilroy, California, El Paso, Texas, and Dayton, Ohio) leaving at least 45 people dead and many dozens more injured, Irvine Mayor Christina Shea intends to create a task force to discuss what we can do in Irvine to prevent gun violence.

Significantly, Mayor Shea asks that we not turn this discussion into a “partisan” issue, and that we not hold local, state, or national politicians responsible for their actions, or lack of action, leading to the proliferation of mass shootings and gun violence.

I fully support a discussion of how our City Council can help prevent Irvine from becoming the site of the next gun violence atrocity. This discussion is long overdue. Our nation is suffering from a gun violence emergency.

But the discussion must not be a sham, and not be muzzled from the very beginning by preventing mention of the fact that Republican politicians — at every level of government — have sided with gun dealers and the NRA over the safety of our communities and families, and have stubbornly blocked Congress from enacting meaningful, common sense federal gun regulation.

We must also be willing to acknowledge the fact that President Donald Trump has incited violence and manipulated racial hatred in ways that many of us had hoped belonged to our tragic past. And we must explicitly reject and condemn Trump’s racist rhetoric.

As President Obama recently said, as elected officials and community leaders, we must reject the rhetoric of those “who demonize those who don’t look like us, or suggest that other people, including immigrants, threaten our way of life, or refer to other people as sub-human, or imply that America belongs to just one certain type of people.” Such language “has no place in our politics and our public life” and it is time “for the overwhelming majority of Americans of goodwill, of every race and faith and political party, to say as much — clearly and unequivocally.”

Let’s have a real discussion of mass shootings and gun violence — without any attempts at mirco-management by the Mayor or self-serving limitations on that discussion being imposed in advance by local politicians who are afraid that the public is fed up with the Republican Party’s spinelessness in the face of the NRA and the racist rhetoric of Trumpism, and their policy of creating diversions after each mass shooting rather than enacting real, common sense, gun control regulation.

I also ask that this Task Force be comprised of and led by real experts in the field of gun violence prevention. We have many such experts here in Irvine on the faculty of UCI and the UCI School of Law.  Our task force should not be solely composed of — or led by — politicians with an interest in self-promotion or self-protection, or protecting their political allies from justified and necessary criticism.

In addition, I suggest that the Irvine City Council immediately direct our Irvine Police Department to promote awareness of California’s Gun Violence Restraining Order (GVRO) law, which allows family members and law enforcement to seek the temporary removal of firearms from someone they believe poses a danger to themselves or others.

While GVROs have been called “the best tool in the state of California for responding to a threat of gun violence,” they are rarely used because residents and law enforcement remain largely unaware of the law and its potential to help stop a crime before it has been committed.

I also propose that the City of Irvine and the Irvine Police Department remind residents about California’s safe storage laws requiring that guns be locked away from minors and anyone who should not have access to them.

I look forward to a lively, positive and open-minded discussion of what we can do in Irvine to prevent mass shootings and gun violence, including an awareness and educational campaign about GVROs, issuing official statements from our City Council calling on President Trump to stop his inflammatory rhetoric demonizing immigrants, Muslims, and people of color, and calling on Congress to pass common sense gun regulations relating to universal background checks, military-style assault rifles, and high capacity magazines.

Irvine Agrees to Fire Museum and Safety Center at the Great Park!

As a long-time advocate for the California Fire Museum and Safety Learning Center, and for preserving the heritage of our California firefighters in a permanent facility in the Great Park, I am thrilled that at my urging the Irvine City Council and the Fire Museum have now agreed on a Memorandum of Understanding for five acres in the Great Park to be designated by the City of Irvine for a 31,000 sq. state-of-the-art, interactive, sensory immersive Fire Museum and Safety Learning Center.

The mission of the California Fire Museum is:

  • To preserve and protect the history and heritage of the fire service in general, with special emphasis on the California Fire Services.
  • To collect, restore, preserve and exhibit apparatus, equipment, art and artifacts of the firefighting profession.
  • To provide life safety, fire safety and fire prevention education to the community.
  • To educate the public about firefighters, firefighting and emergency services.

OC Register Editorial: Democracy Cannot be Stage-Managed by the Majority for their Own Convenience and Political Advantage

The Orange County Register’s editorial of July 17, 2019, correctly calls out and condemns the recent move by the Irvine City Council to prevent a Council Member from putting an item on the agenda unless two other members agree to do so.

As the Register states, “The transparent goal is to shut down the views of the political minority. Irvine officials said they want to stop ‘grandstanding,’ but one person’s grandstanding is another’s chance to raise vital concerns.”

The Register also recognizes that while the new rule was adopted specifically to silence me, the effect of the rule will be to silence all disagreement and dissent:

“Fox has previously discussed supposedly ‘divisive’ issues ranging from flying the LGBTQ flag at City Hall to creating a veterans’ cemetery near the Great Park. But this fracas isn’t about the particular issues any member might want to discuss, but about whether a duly elected official has the right to publicly discuss them. Councils are not private clubs . . . These are the public’s meetings and all officials, even minority voices, represent their constituencies. All elected bodies need to encourage wide-ranging discussions so the public can be part of the self-government process – and not just observers of a carefully crafted script. That’s the essence of representative democracy.”

Thank you to the OC Register for recognizing that public meetings in a real democracy cannot be stage-managed by the majority for their own convenience and political advantage.

As I’ve said before, Irvine’s current pro-Trump Council majority, again aided by its ostensibly Democratic ally, has made it clear that they are following in Irvine the very same playbook of obstruction and bullying used in Washington by Trump and Mitch McConnell, and with the same goal: to silence opposing voices.

But I have no intention of being silent.

And neither do you.

As with Trump and McConnell, we must persist and resist every day, and throw them out decisively in November 2020.

In the meantime, I’ll continue to raise my voice to speak for progressive policies and values — like respect for LGBTQ people, a state cemetery for our veterans, implementation of a serious plan to tackle climate change, more accessible child care, ending sexual violence and discrimination in the workplace, building affordable housing, and ensuring greater government transparency — as I was elected to do.

No, We Won’t Back Down

At its last meeting, the Irvine City Council took the unprecedented step of voting to prohibit a council member from placing an item on the agenda without two other council members’ approval.

Now, only the mayor will be allow to put an item on the agenda — a power that until last week had for decades belonged to every individual member of the City Council.

There have been many shifting majorities on the City Council over the years, but no other Council has gone so far to silence dissenting voices and points of view.

You can read about what took place in this excellent article in Voice of OC, including how this new rule is directed squarely at me in retaliation for proposing that Irvine fly the Pride Flag at City Hall, and how they made sure to propose the new rule — and then quickly enact it —  while I was on a long-planned trip to Alaska.

The truth is that Irvine’s Republican, pro-Trump Council majority — created by appointment in a back-room deal with its ostensibly Democratic ally and the developer FivePoint — has made it clear that they are following in Irvine the very same playbook of obstruction and bullying used in Washington by Trump and Mitch McConnell, and with the same goal: to silence opposing voices.

Urge the Irvine City Council to Adopt a Climate Action Plan Without Delay!

I’m unable to attend the Tuesday, July 9, 2019, Irvine City Council meeting because I’m on a long-planned trip to visit my son in Alaska.

Although I’m not able to be present, I urge you to attend the City Council meeting and speak in support of the City creating a Climate Action Plan without delay.

Action on climate and the environment have been crucial issues for me as a member of the Irvine City Council and as Chair of the Irvine Green Ribbon Environmental Committee.

Interestingly, I’m unable to attend the City Council meeting because I’m currently in Glacier Bay National Park, which is perhaps the place on earth where the effects of climate change can most dramatically be seen.

The magnificent tidewater glaciers here have been receding at an alarming rate because over time the snowpack has been inadequate to counteract the impact of long-term temperature increase.

In addition, the sky here is thick with smoke from more than 120 wildfires, because Alaska, like California, is suffering from the effects of long-term drought as well as climate change.

From my current vantage point in Glacier Bay National Park, there is no greater issue demanding action than climate change.

Please read the very compelling letter that Climate Action Campaign Orange County has sent to members of the Irvine City Council, explaining the urgent need for — and the benefits of — a swift adoption of a Climate Change Plan for Irvine.

As Climate Action Campaign Orange County Organizer Robin Raeder Ganahl has aptly stated, “Irvine residents deserve to know what the City’s plan is to reduce emissions, meet state targets, and protect their quality of life!”

I hope you can attend the Tuesday, July 9, 2019, Irvine City Council meeting, as well as write to the Mayor and the City Council, explaining why this issue matters to you.

Your participation in support of Irvine’s adoption of a Climate Action Plan can make a very big difference, not just for our generation but for generations to follow.

Join Me at the Green Ribbon Committee Meeting on Monday, June 24, to Discuss the Community Choice Energy Study!

Community Choice Energy (CCE) is a way for cities, counties or regions in California to look out for their own energy interests, a hybrid between regulated and deregulated electricity supply. CCE programs seek to provide energy that is cheaper and cleaner than energy provided by for-profit utility companies.

Under a CCE program, the local utility company still provides all of the billing services and infrastructure to supply electricity to the point of use, but they are no longer responsible for selecting the electricity supplier. Instead, the community chooses its energy supplier. CCEs across the state are now offering more renewable energy content, and at lower cost, than the electricity supplied by the utility company.

On September 25, 2018, before a standing-room crowd, I joined with my colleagues on the Irvine City Council in voting to commission a feasibility study to determine the pros and cons of implementing a CCE program in Irvine, including potential economic benefits for the community.

The proposal for a feasibility study of CCE in Irvine was initially developed and endorsed by the Irvine Green Ribbon Environmental Committee, which I have the honor to serve as Chair.

We now have that study, as EES Consulting has completed a comprehensive analysis of the viability (including costs and benefits) of a Community Choice Energy program in Irvine.

Among the study’s crucial conclusions is the projection that a CCE in Irvine would result in $7.7 million per year in citywide electricity cost savings for Irvine residents and businesses, and a $112,000 per year savings for the City itself in municipal energy costs.

The study further reports that implementation of a CCE program in Irvine is likely to drive additional local economic development benefits, such as new jobs and $10 million in annual economic output.

While the study notes that there is some risk involved, it also points to several strategies by which these risks could be mitigated and managed.

As a member of the Irvine City Council and as Chair of the Green Ribbon Commission, I am tremendously excited by this study and its conclusions.

The Green Ribbon Environmental Committee will be discussing the study and next steps to take regarding implementation of Community Choice Energy in Irvine at our meeting on Monday, June 24, 2019, at 4:30 in Room L102 at Irvine City Hall. 

I urge everyone interested to attend the meeting and to speak up for cleaner, cheaper energy.

Join me on Saturday, June 22, 2019, for the Annual Car Wash fundraiser in support of Irvine 2/11 Marine Adoption Committee to directly benefit the 2/11 Marines.

The car wash will take place from 9:00 am to 2:00 pm at Lakeview Senior Center in Mike Ward Community Park in Woodbridge.

Irvine is proud of its military heritage, especially its close connection to the United States Marine Corps.

From 1943 to 1999, Irvine was the home of Marine Air Station El Toro, which was once the largest Marine air station on the West Coast. Thousands of Marines served here, and thousands more flew from here to battles in World War II, Korea, and Vietnam.

Many never returned.

On September 15, 2007, the 2nd Battalion, 11th Marine Regiment, 1st Marine Division (2/11) from Camp Pendleton, was officially “adopted” by the City of Irvine. The City of Irvine and the 2/11 Marines made a pledge to encourage mutually beneficial interactions between the community and the battalion.

The 1st Marine Division is the oldest, largest and most decorated division in the United States Marine Corps. The 2nd Battalion, 11th Marines (2/11) is a 155mm howitzer battalion based at Camp Pendleton, California. Its primary mission is to provide artillery support to the 5th Marine Regiment in time of conflict. At any time, the command has roughly 750 Marines and Sailors assigned to it.

The battalion’s exemplary service ranges from France in World War I to the Battles of Guadalcanal and Okinawa in the Pacific in World War II to Inchon and the Chosin Reservoir in the Korean War (where my cousin USMC Pvt. Irwin Handler was killed in action), to Hue and Phu Bai in Vietnam to Operations Desert Shield and Desert Storm in the Gulf War to Operation Enduring Freedom in Kuwait to the more recent campaigns in Iraq and Afghanistan.

The Irvine 2/11 Marine Adoption Committee , a 501(c)(3) non-profit organization, provides charitable and educational activities and support for the benefit and welfare of the United States Marines and their families assigned to Camp Pendleton, with special emphasis on the Marines and families of the 2nd Battalion, 11th Marines (“2/11 Marines”).

Additionally, the Committee seeks to educate and inform the community regarding the 2/11’s activities and responsibilities.  The Committee accomplishes its goal by soliciting private and public donations of cash, food, beverages, and new and used material goods to help underwrite the cost of sponsoring 2/11 Marines and their families.

The Irvine 2/11 Marine Adoption Committee welcomes the Irvine community to support our adopted battalion by participating and donating to a variety of activities. These activities include holiday and pre-deployment events, care packages, toy drives and more.

Join Us on Friday, June 21, 2019, for Irvine’s Super Swim Lesson!

Kick off summer in the pool with the Irvine Super Swim Lesson on Friday, June 21, at William Woollett Jr. Aquatics Center!

Adults and children of all swimming abilities are invited to participate in the Super Swim Lesson, a worldwide effort to raise awareness for drowning prevention.

Arrive at 5:30 p.m. to sign up for the one-time lesson to be held at 6:00 p.m., then stay for the free recreation swim that includes a water slide, giant inflatable, and diving boards.

At dusk, the movie Trolls plays on the big screen. Lifeguards will be on duty.

For recreation swim, children 6-years-old and younger must be accompanied by an adult one-on-one in the water.

State Treasurer Fiona Ma Announces $20 Million in Sales Tax Aid for Irvine-Based Biotech Company Edwards Lifesciences

I’m extremely pleased to report that California State Treasurer Fiona Ma has approved up to $20 million in sales tax benefits for Irvine-based biotech company Edwards Lifesciences to upgrade and expand a facility that makes devices to treat cardiovascular disease.

This action will support the retention and creation of 974 production jobs and 90 construction jobs, primarily in Orange County.

The award to Edwards Lifesciences was one of several approved by the California Alternative Energy and Advanced Transportation Financing Authority (CAEATFA) which is chaired by Treasurer Ma.  CAEATFA works collaboratively with public and private partners to provide innovative and effective financing solutions for California’s industries, assisting in reducing the state’s greenhouse gas emissions by increasing the development and deployment of renewable energy sources, energy efficiency, and advanced transportation and manufacturing technologies to reduce air pollution, conserve energy, and promote economic development and jobs.

Edwards Lifesciences makes transcatheter heart valves, surgical heart valves, and blood flow monitoring devices. In 2011, it made the first aortic value approved in the U.S. that does not require open heart surgery to place inside the patient.

In announcing her decision, Treasurer Ma stated that Irvine’s Edwards Lifesciences is “the kind of company that we need to keep in California. Edwards Lifesciences is saving lives and keeping our state on the cutting edge of technology, and doing all of this while reducing its energy consumption.”

The sales tax benefits will be applied to the purchase of $239 million of production equipment, facility improvement, tooling equipment, lab instruments, computers, and information technology. The upgrade, according to the company, will reduce energy use by 10 percent and trim the amount of hazardous and solid waste produced by the facility.

Edwards Lifesciences employees approximately 5,000 people in Orange County.

I have had the privilege of being friends with California State Treasurer Fiona Ma for many years and have long been a supporter of her approach to business-government relations and her efforts to promote economic development and jobs while also protecting the environment.

I am very happy to see that her policies as Treasurer are having a direct and positive impact on people and businesses here in Orange County.

Join Orange County Fire Authority Girls Empowerment Camp Summer 2019!

As a Board Member of the Orange County Fire Authority, I am proud to help promote OCFA’s Girls Empowerment Camp!

Girls Empowerment Camp is a free two-day camp open to teenagers 14-18 that introduces them to the fire service and provides campers with a realistic, hands-on overview of firefighting.

The camp exposes the teens to all aspects of a fire service career beginning with requirements. The program also empowers campers with life skills and professional guidance that encourages them to pursue a career in public safety. The camp is being held at the Orange County Fire Authority Training Center, located on 1 Fire Authority Road in Irvine.

The free 2-day camp will feature six hands-on stations for the campers to gain familiarity and experience with fire service functions.

The activity stations will include: Ropes and Knots, CPR/First Aid, Aerial Ladder Climb, Confidence Course, Roof Prop and Hose Handling.

Thanks to the generosity of the Orange County Fire Authority Foundation, campers will receive an OCFA/GEC:

  • T-shirt
  • Hat
  • Water bottle
  • Backpack.

The OCFA Foundation will also provide lunch, healthy snacks, and water for the campers.

Meet “Captain Cal” — CAL FIRE’s New Ambassador for Fire Safety and Prevention!

I had the opportunity yesterday in Sacramento to attend the introduction of “Captain Cal” — CAL FIRE’s Fire’s new ambassador for fire safety and prevention — to the people of California.

Chief Thom Porter, the Director of California’s Department of Forestry and Fire Protection, announced that Captain Cal’s primary mission is to help expand CAL FIRE’s educational outreach and to teach children about emergency preparedness, fire safety and prevention, safe and sane fireworks, and water safety.

Assemblymember Christy Smith, Chair of the Joint Legislative Committee on Emergency Management, pointed out that Californians need to be prepared for the “new normal” of a year-round California fire season.

Climate change, couple with population growth, has drastically increased the frequency, severity and destructiveness of wildfires. Ten of the 20 most destructive fires in California history have occurred since 2015.

In 2018 alone, more than 2 million acres of California’s forests burned. The combination of many years of drought followed by recent heavy rains means that we should expect more severe fires again this year.

Under Governor Gavin Newsom and Chief Porter, the State of California is significantly increasing it’s commitment to wildfire prevention and response, as well as education, in the face of these new conditions.

Captain Cal’s motto is “Safety starts with you!”

June is PTSD Awareness Month: Tell Your State Legislators to Support PTDS Care for Police and Firefighters!

June is PTSD Awareness Month.

PTSD stands for Post-Traumatic Stress Disorder and is a condition that impacts many military veterans and first responders, such as police and firefighters.

PTSD can occur when someone experiences or witnesses a traumatic event.  This condition wasn’t always understood properly by the medical or military community. “Shell shock” and “battle fatigue” or “combat fatigue” were earlier attempts to define and understand the symptoms of PTSD.

Post-traumatic stress disorder and those who suffer from it were often maligned and stigmatized in popular culture after the Vietnam War, and many films and television shows featured antagonists or unsympathetic characters suffering from “Vietnam flashbacks” or other post-combat issues.

This misunderstanding of PTSD slowly began to change in 1980 when it was recognized as a specific condition with identifiable symptoms. As a result, since that time Post-Traumatic Stress Disorder is listed in the American Psychiatric Association’s Diagnostic and Statistical Manual of Mental Disorders (DSM). Today, the symptoms of Post Traumatic Stress Disorder are better understood, treatable, and recognized by the Department of Veterans Affairs as a service-connected condition.

Now we are recognizing that because of the nature of their jobs, police and firefighters, like military combat veterans, are routinely exposed to traumatic events that can lead to Post-Traumatic Stress Disorder. For this reason, police and firefighters are twice as likely as the general population to experience PTSD.

Currently, however, it is often difficult for police and firefighters in California to receive the treatment that they need and deserve.

New legislation — SB 542 — would provide that in the case of certain state and local firefighting personnel and peace officers, the term “injury” also includes a mental health condition or mental disability that results in a diagnosis of post-traumatic stress or mental health disorder that develops or manifests itself during a period in which the firefighter or peace officer is in the service of the department or unit.

This new legislation recognizes that “Today, a firefighter’s and law enforcement officer’s occupational stress is heightened in the face of California’s ‘new normal’ in which wildland and wildland-urban interface fires continue to annually increase as hot, dry, and wind-whipped conditions persist” and that “Last year’s fire storms were a brutal reminder of the ferocity of wildfires and how all too often on-duty firefighters and law enforcement officers incur the stress of witnessing victims flee while worrying about whether their own homes, and the safety of their families and neighbors, are threatened. When on duty, firefighters and law enforcement officers endure the added pain of driving through wreckage, seeing destroyed homes, or worse, the skeletal remains of family, friends, and neighbors burned to ash while not being able to stop to provide assistance or comfort.”

The legislation further recognizes that “While the cumulative impacts of these aggressive, deadly events are taking their toll, our firefighters and law enforcement officers continue to stand up to human-caused devastation and nature’s fury, but they are physically and emotionally exhausted” and that “California has a responsibility to ensure that its fire and law enforcement agencies are equipped with the tools necessary to assist their personnel in mitigating the occupational stress experienced as a result of performing their job duties and protecting the public.”

For these reasons, the intent of the legislation to “recogniz[e] the hazards and resulting trauma of these occupations and provide treatment and support for these public servants through presumptive care to our firefighters and law enforcement officers.”

As the daughter of a police officer and the mother of a firefighter, I strongly support SB 542 and it’s goal of providing treatment for police and firefighters suffering from service-related PTSD.

I urge everyone in California to contact their representatives in both the State Senate and the State Assembly to urge them to Vote Yes on SB 542!

Congratulations to Irvine on Earning Top Parks Rating in California and 6th in the Nation!

The City of Irvine park system has been ranked 6th in the nation by the Trust for Public Land annual ParkScore Index, effectively making Irvine the top-ranked city in California.

Significantly, with new parks, open space, and amenities added over the past year, the City rose from last year’s ranking of 10th in the nation, climbing up four places.

The Trust for Public Land’s ParkScore rankings assess the nation’s 100 largest cities on factors such as park access, acreage, investment, and amenities. Irvine earned a perfect sore in park spending per resident, and is second in the national for basketball hoops per 10,000 residents.

Among the factors considered in the evaluation is the fact that 80 percent of Irvine’s residents live within a 10 minute walk of a park (compared to a national average of 54 percent) and that 27 percent of Irvine’s city land is used for parks and recreation (compared to a national average of 15 percent).

Of special note, the ParkScore Index did not find any significant difference regarding closeness to parks in Irvine based on the race, nationality, age, or income level of Irvine residents.

The ParkScore Index includes parks, facilities, and amenities managed by the City, either through ownership or joint-use agreements.

Join Me for the 13th Annual Super Pet Adoption Event on Sun., June 2!

Join me for Irvine’s 13th Annual Super Pet Adoption Event on Sunday, June 2 from 10:00 a.m. to 3:00 p.m.  More than 40 pet rescue groups and animal shelters will bring some 600 homeless dogs, cats, rabbits and small animals for adoption.

The Super Pet Adoption Event features dozens of vendors, gourmet food trucks, a silent auction, low-cost microchipping and an opportunity drawing.  Each animal available for adoption is spayed or neutered, microchipped and evaluated by a veterinarian.  Cats and dogs are vaccinated appropriate to age.

The suggested donation for the event is $2 per person or $5 per family.  Parking is free.  Event proceeds benefit the Irvine Animal Care Center in its efforts to provide care and support to thousands of homeless, neglected and abused animals each year.

Seniors Helping Seniors

There will be lots of adorable animals who need forever homes at the Super Pet Adoption Event, but the best pet for you, especially if you are a senior, is a senior animal.

One of the best programs of the Irvine Animal Care Center is “Seniors Helping Seniors.”  In order to help both the senior people and the homeless senior pets of our community, the Irvine Animal Care Center has implemented a new program that will allow individuals age 62 and older to adopt a senior pet at no charge.  Many of our senior pets came from a nice home environment and were relinquished because their owners could no longer care for them.

The stress of shelter life is often quite difficult for senior animals and so the quicker they can find a good new home, the better. These animals are often already housebroken, so they make great companions for senior citizens.

Adoption hours at the Irvine Animal Care Center are noon to 6:00 p.m. on Monday, Wednesday, Thursday and Friday, and 10:00 a.m. to 4:00 p.m. on Saturday and Sunday. The Center is closed on Tuesdays and holidays.

Please allow yourself at least one hour to visit with adoptable animals.  Look for the green “senior” stamp on the kennel cards to identify adoptable seniors.

Bunnies are Best in Bunches

Dogs and cats are not the only animals looking for forever homes at the Irvine Animal Care Center.  The Center also has many super cute bunnies for adoption.

Rabbits make wonderful pets for the right people.  According to the website Petfinder, “Rabbits have strikingly distinctive personalities. They can be as playful and silly as puppies or kittens, as independent and fascinating as cats, or as loyal and openly affectionate as dogs. And long-time rabbit owners claim that domestic rabbits are, in their own way, every bit as smart as cats and dogs. . .  If you want a fascinating, funny, warm and wonderful companion animal, try a rabbit.”

Many of the bunnies at the Center are litter-mates who are bonded to each other.  For that reason, if you can, it might be a great idea to adopt two or three bonded siblings.

Whatever animal you adopt, or whether you just come visit the animals and support the Irvine Animal Care Center, I’m sure you’ll have a great time at the Super Pet Adoption Event.

Invitation to Attend the Irvine Transportation Commission Meeting on Tuesday, May 21, 2019, to Hear the Stop Sign Compliance Report!

You are invited to attend the Irvine Transportation Commission on Tuesday, May 21, 2019 at 5:30 p.m., when the City’s Stop Sign Compliance Report  — requested by me in response to residents’ complaints about motorists not obeying stop signs in Irvine —  will be presented to the Commission and to the public.

The Stop Sign Compliance Report was prepared at my request because I am very concerned that although Irvine is world-famous as a safe place to live and raise our families, it won’t stay that way unless all Irvine’s motorists obey the stop signs and respect pedestrians’ right-of-way.

It’s not just our reputation as America’s safest city that is on the line. Our lives, and the lives of our children, are at stake.

The Report is the only item on the agenda.

The public is invited to attend the presentation and ask questions.

This is the first step in the process.  It remains to be seen if the Commission will recommend more enforcement or larger stop signs to improve compliance.  That’s why it is important for the concerned public to see this presentation!

Transparency Requires the Immediate Release of City Council Candidates’ Applications and the Postponement of Hearings Until the Public Has Had Time to Read Them

Transparency requires the immediate public release of the Irvine City Council candidates’ applications, as well as the postponement of any hearings on the applicants until the public has had time to read them.

The City Council explicitly promised that the application process would be open and transparent.

The Council also stated that the public would have the right to participate meaningfully in the appointment  process.

However, consideration of the candidates by the Council based on applications that are hidden from the public is the very opposite of transparency and openness.

In addition, transparency and openness requires that the public have sufficient time to read and review these applications before any public hearing on appointments.

Therefore, I plan to call upon my colleagues on the City Council to order staff to immediately release the candidates’ applications, and that any hearing be postponed for at least one week to give the public time to read and consider them.

As Chair of the Irvine Community Land Trust, and as a longtime advocate for more affordable housing, I am very pleased to announce that the Irvine Community Land Trust has been awarded the Platinum Seal of Transparency from GuideStar, the world’s most respected source of information on nonprofit organizations.

This award is the highest honor that GuideStar can bestow — an objective and authoritative affirmation of the Irvine Community Land Trust’s dedication to transparency and openness.

In fact, the Irvine Community Land Trust trust goes well beyond what is expected of a typical nonprofit by voluntarily keeping our board meetings open to the public, by making our board agendas and minutes, going back to 2012, available online, as well as by making our financials and tax returns available online for all to see.

Nonprofit organizations like the Irvine Community Land Trust that work to create more affordable housing are often under attack from NIMBY groups.  That’s one of the reasons why I’m so delighted to see that GuideStar, a universally well-respected and objective organization, has officially recognized the commitment to openness of the Irvine Community Land Trust with their highest award for transparency!

Join Me to Honor our Fallen Heroes in Two Ceremonies this Memorial Day Weekend

Please join me on Memorial Day  weekend as we honor the brave men and women who have made the ultimate sacrifice for our nation and pays special tribute to our local service members and veterans.

Orange County has a long and proud military tradition.

From 1942 to 1999, Irvine was home to Marine Air Station El Toro, the largest Marine Corps Air Station on the West Coast. During World War II, the Korean Conflict, and the Vietnam War, thousands of United States Marines, as well as airmen, sailors and soldiers, departed for war from MCAS El Toro.

Many never returned.

As the daughter of a combat veteran, as the cousin of a Marine who was killed in action, and as an Irvine City Councilmember, I am proud of Irvine’s commitment to honoring our veterans, especially those who made the ultimate sacrifice for our freedom.

The Northwood Gratitude and Honor Memorial, dedicated in 2010, is the nation’s first and only memorial dedicated exclusively to listing the names of all the fallen American service members in Afghanistan and Iraq.

The names of every service member who has died in Afghanistan and Iraq are engraved in granite in a permanent memorial, to assure that future generations of Americans will remember and honor them with gratitude as we do today.

The ceremony will honor our fallen heroes from all generations, with special tribute to those fallen heroes of the recent and ongoing wars in Afghanistan and Iraq. The candle lighting ceremony will include presentations from and honor Gold Star families. Please bring lawn chairs or blankets for seating.

Attendees will have the opportunity to memorialize our troops’ sacrifice by writing a brief Remembrance Card to be posted on a memory board.

As I have done in past years, I will be filling out a memorial card for my cousin, PFC Irwin Handler, USMC, who was killed in Korea, and for the son of family friends, LCPL Donald J. Hogan, USMC, Navy Cross, who was killed in Afghanistan.

Wildfire Preparedness Week: Wildfire is Coming . . . Are You Ready?

As CAL FIRE, reminds us, Wildfire is coming . . . Are you ready?

This is Wildfire Preparedness Week.

Each year California highlights the importance of wildfire prevention and preparedness by declaring the first full week of May as “Wildfire Preparedness Week.”

This year during the week of May 5-11, CAL FIRE, Orange County Fire Authority (OCFA) and fire departments across the state will remind residents of the dangers posed by wildfires and the simple steps that should be followed to prepare for and prevent them.

Despite getting some much-needed rain this winter, we’re expecting another dangerous fire season.

One Less Spark, One Less Wildfire!

Approximately 95 percent of all wildfires are sparked by the activity of people, which means that almost all wildfires are preventable.

One of the leading causes of wildfires is outdoor powered equipment. Use powered equipment before 10 a.m. and never on hot and windy days. When clearing dead or dying grass don’t use a lawn mower or weed trimmer with a metal blade.

Make sure your vehicle is properly maintained with nothing dragging on the ground like trailer chains. All residents and vacationers need to be extra cautious outdoors because one less spark means one less wildfire.

Ready, Set, Go! 

With fire activity already above average, Californians should remember “Ready, Set, Go!”

Ready: Protect your home ahead of time by taking steps to mitigate wildfire risk.

Set: Prepare for an emergency by assembling a bag of important items that you would need in the event of emergency. This includes clothes, medication and other personal items. Develop a family emergency plan that details escape routes and reunification plans.

Go: Leave early in the event of an emergency. Avoid traffic congestion and other complications by evacuating at the earliest opportunity. In the event of evacuation, all City of Irvine emergency shelters will have options available for pets.

All You Need is Love: Volunteers Needed to Foster Kittens!

It’s kitten season.

Every week, dozens of stray kittens are brought into the Irvine Animal Care Center and the OC Animal Shelter in Tustin.

Many of these kittens are too young to even open their eyes, and unfortunately many of them will not survive without their mothers.

Neonatal kittens are especially susceptible to picking up infectious diseases in-shelter because their immune systems are so weak

Many of the current shelter volunteers already foster kittens at home, but their resources are stretched thin.

New volunteers are needed who can foster the kittens, which involves bottle feeding the kittens every three or four hours.

The kittens can survive only with this attention and care.

Bottle baby fostering may be best for people who work from home, have flexible schedules, or are retired.

Operation “Southern Wind” — Our First Responders Train for a “Dirty Bomb” Terrorist Attack

This week, as a board member of the Orange County Fire Authority, I had the amazing opportunity to observe the 2019 Urban Search and Rescue Multi-Task Force Mobilization Exercise “Southern Wind” at the Del Valle Regional Training Center in Castaic, California, in which our first responders trained to deal with a “dirty bomb” terrorist attack.

The scenario was that a vehicle containing a “dirty bomb” had exploded, spreading radioactive contamination and toxic smoke across a wide area and demolishing a mall and a hospital, with many fatalities and injured victims, as well as many people trapped in the rubble.

The participating agencies included the Governor’s Office of Emergency Services (CalOES), Cal Trans, the Federal Emergency Management Agency (FEMA) Urban Search and Rescue (US&R) Branch, the Los Angeles County Sheriff’s Department, the California Highway Patrol, the Orange County Fire Authority (OCFA), California US&R Task Force 5 (CA-TF5) from OCFA, California US&R Task Force 6 (CA-TF6) from the Riverside Fire Department, California US&R Task Force 8 from the San Diego Fire Department, and the HazMat Task Force from the Los Angeles County Fire Department.

The goal of the exercise was to demonstrate the ability of Southern California-based local, state, and federal US&R Task Forces to meet FEMA Operational Readiness Exercise Evaluation Program requirements, and demonstrate Multi-Task Force cooperation in response to an incident involving a Radiological Dispersal Device.

The overall Incident Commander, and most of the section commanders, were with the Orange County Fire Authority.

Among the actions taken were decontamination and securing of the area, searching for victims (including using search dogs), and extraction of victims from the rubble (including using cranes to lift debris and motor vehicles).

Due to the danger of exposure to radiation, the crews needed to rotate frequently.

My very helpful and patient “guide” during the exercise was OCFA US&R Coordinator Captain Richard Ventura.

Also taking time to keep me informed was OCFA Captain Wendy Norwood, whose normal duty station is OCFA Fire Station 27 in Portola Springs.

I was tremendously impressed by the smoothness and thoroughness of the operation, the coordination and cooperation among the different agencies, the amazing level of skills demonstrated, and the dedication of all the participants.

I was also extremely proud of the leadership role taken by our own Orange County Fire Authority.

Irvine Community Land Trust Featured in Case Study in UC Berkeley’s Affordable Housing Series

As Chair of the Irvine Community Land Trust, and as an Irvine City Councilmember who has made helping to create affordable housing a priority, I am excited that the Land Trust was recently featured in a case study by the Terner Center for Housing Innovation at UC Berkeley, exploring the impact that local efforts can have in improving the state’s housing crisis.

The Terner Center explains that “Cities have an important role to play in addressing California’s affordable housing shortage, and local policies such as community land trusts, reforming impact fees, and reducing barriers to multi-family housing production can all make a significant difference. Made possible by the support of California’s Department of Housing and Community Development, the Terner Center has conducted a series of case studies to explore how action at the local level can help to address the state’s housing shortfall.”

The case study explains that “Homes for sale or rent within a CLT [Community Land Trust} are permanently held below the market cost while also offering the potential for residents to build equity and share in the economic advancement of their neighborhood.

Faced with rising housing costs and a steady decline in affordable homes, Irvine, California created the Irvine Community Land Trust (Irvine CLT) in 2006 to ensure that all new units created using a public subsidy or as a result of the city’s inclusionary housing ordinance would remain affordable in perpetuity.”

It notes that the Land Trust has recently run into greater opposition from some residents who oppose additional housing, noting that “While
initially the Irvine CLT only developed on vacant land without much neighborhood opposition, the CLT reported that they had
begun to experience neighborhood resistance to an infill project.”

In fact, one of the most difficult to overcome obstacles to creating affordable housing throughout California is resistance from the affluent neighbors, which was the subject of a special — and packed — session at the 2019 Housing California Conference I attended this month in Sacramento.

At the Irvine Community Land Trust, we have sought to overcome resistance and generate community support by voluntarily continuing to keep our board meetings open to the public, by making our board agendas and minutes, going back to 2012, available online, as well as by making our financials and tax returns also available online.

Irvine City Council Issues Proclamation Remembering Holocaust and to “Remain Vigilant Against Hatred, Persecution, and Tyranny”

At the Irvine City Council meeting on April 23, 2019, the Council unanimously voted in favor of my motion for an official proclamation recognizing April 28 – May 5, 2019, as “Days of Remembrance” in memory of the victims of the Holocaust, and in honor of the survivors, rescuers and liberators, and urging all to “remain vigilant against hatred, persecution, and tyranny.”

I want to thank the Mayor and my City Council colleagues for their unanimous support for this proclamation. The memory of the Holocaust should serve as a reminder throughout the ages of the need to treat all people with respect and dignity, and to ensure that hatred, bigotry, and tyranny have no place in America or any civilized community.

The proclamation reads as follows:

DAYS OF REMEMBRANCE

April 28 – May 5, 2019

WHEREAS, the Congress of the United States established the United States Holocaust Memorial Council to create a living memorial to the victims of the Nazi Holocaust, to never lose memory of that terrible moment in time; and

WHEREAS, the Holocaust was the persecution of European Jewry by Nazi Germany and its collaborators between 1933 and 1945, and Jews were the primary victims – six million were murdered along with millions more targeted for racial ethnic or national reasons; and

WHEREAS, the history of the Holocaust offers an opportunity to reflect on the moral responsibilities of individuals, societies, and governments as well as remember the terrible events of the Holocaust and remain vigilant against hatred, persecution, and tyranny by rededicating ourselves to the principles of individual freedom in a just society; and

WHEREAS, the Days of Remembrance have been set aside to remember the victims of the Holocaust as well as to reflect on the need for respect of all people; and

WHEREAS, pursuant to an Act of Congress the United States Holocaust Memorial Council designates the Days of Remembrance of the Victims of the Holocaust to be Sunday, April 28 through Sunday, May 5, 2019, including the international Day of Remembrance known as Yom Hashoah on May 1;

NOW THEREFORE, the City Council of the City of Irvine DOES HEREBY PROCLAIM APRIL 28 – May 5, 2019, as “Days of Remembrance” in memory of the victims of the Holocaust, and in honor of the survivors, as well as the rescuers and liberators.

The Council also showed a powerful video on the Holocaust. Unfortunately, studies show an alarming number of American teens don’t know about the Holocaust. In the video, teens reflect on their visit to concentration camps in Poland where millions of Jews were killed.

This proclamation also serves as a reminder that antisemitism — and any form of racism or bigotry — will not go unchallenged by the good people of Irvine.

Irvine will always stand strong against hatred and intolerance and stand up for our neighbors.

An attack on anyone in Irvine because of their faith, race, or national origin, is an attack on us all.

Irvine Shares the Way: Improving the Safety of Everyone in Irvine, Whether Walking, Bicycling, or Driving.

Irvine Shares the Way!

Irvine is world-famous as a safe place to live and raise our families. But it won’t stay that way unless all Irvine’s motorists obey the stop signs and respect pedestrians’ right-of-way.

Residents of Irvine are very concerned — and rightfully so — about their safety and the safety of their children because of the consistent failure of drivers to come to a full and complete stop at our stop signs and obey all the rules of the road.

It’s not just our reputation as America’s safest city that is on the line.  Our lives, and the lives of our children, are at stake.

As member of the Irvine City Council, I’ve taken an active and leading role in making Irvine safer for pedestrians, drivers, and bicyclists.  I’ve participated in the Ride of Silence, I’ve put stop sign safety on the top of the Transportation Commission agenda, I’ve met with our police chief to discuss traffic safety improvements and ensure traffic law compliance, and I’ve held a Town Hall on Traffic Safety.  

Now Irvine has introduced a new initiative called Irvine Shares the Way.

Irvine Shares the Way is a project to improve the safety of everyone in Irvine, whether they are walking, bicycling, or driving. Irvine Shares the Way is a broad-based campaign, including educational materials, safety workshops, and other activities across the City of Irvine.

The campaign will help raise awareness of traffic laws and remind residents how they can reduce the chances of a collision when they are walking, bicycling, and driving.

Strategic Active Transportation Plan

As part of the Irvine Shares the Way campaign, the Strategic Active Transportation Plan, with your input, will help guide the development of pedestrian and bicycle facilities and implement upgrades to existing facilities. The Plan will create one master document, which will review and recommend best practices, such as:

  1. Technology needed to implement a citywide bicycle and pedestrian count program; 
  2. Design standards for bicycle and pedestrian facilities;
  3. Ranking criteria for prioritizing bicycle and pedestrian projects and;
  4. Methodology and software applications for forecasting bicycle and pedestrian travel.

The completed Plan will also aid the preparation of grant applications to fund active transportation projects that are a result of this initiative.

The City of Irvine provides a network of on-street and off-street bikeways to encourage the use of bicycles as a safe and convenient means of transportation for both commuting and recreational purposes. This is evident by 301 lane miles of on-street and 61.8 miles of off-street bikeways provided in the City today.

Happy Earth Day 2019!

Today, Monday, April 22, is Earth Day.

Nearly 50 years ago, on April 22, 1970, millions of people took to the streets to protest the negative impacts of 150 years of industrial development.

In the US and around the world, smog was becoming deadly and evidence was growing that pollution led to developmental delays in children. Biodiversity was in decline as a result of the heavy use of pesticides and other pollutants.

The global ecological awareness was growing, and the US Congress and President Nixon responded quickly.  In July of the same year, they created the Environmental Protection Agency, and robust environmental laws such as the Clean Water Act and the Endangered Species Act, among many.

Earth Day is now a global event each year, and more than 1 billion people in 193 countries now take part in what is the largest civic-focused day of action in the world.

The City of Irvine has been a leader in earth-friendly environmental policies, green technology, and environmental awareness.  Irvine’s environmental programs have been on the leading edge of advances in green building and construction, environmental education, recycling, water conservation, waste disposal, and energy-saving.

Unfortunately, when Steven Choi was Irvine’s mayor, our city took several steps backwards. The term “climate change” was banned from all city documents and not enough Councilmembers made appointments to the Green Ribbon Environmental Committee to enable a quorum.

Mayor Steven Choi even refused to participate in the National Mayor’s Challenge for Water Conservation, sponsored by Irvine’s own Wyland Foundation.

When I joined the Irvine City Council, I successfully pushed for revitalization of the Committee, which has now resumed its work of serving as the official environmental advisory committee, increasing public participation in energy conservation and sustainable practices, and helping the city serve the community through advancing environmental policy initiatives and programs.

I am delighted that the Committee now has the full support of the entire City Council, and both Mayor Don Wagner and Mayor Christina Shea have joined with other mayors across the country in asking residents to make a commitment to conserve water and protect this vital resource by taking part in annual Wyland Mayor’s Challenge for Water Conservation, through the month of April.

One of the best — and most distinctive — qualities of Irvine is our commitment to preserving open space. The City of Irvine has more than 16,000 acres of permanently preserved parkland and open space – remarkable for a city of our size.

In 1974, early in our city’s history, voters approved multi-million dollar measures to fund public parks and recreational facilities, and for the acquisition and development of bicycle trail and hiking trail improvements.

In 1989, the City negotiated an historic agreement with the Irvine Company that set aside more than 9,500 acres as permanent open space marshlands, bike trails, parks, nature conservancies and agricultural areas, protecting fully one-third of the city from development.

In addition, in 2006, nearly 37,000 acres of the Irvine Ranch were selected as a National Natural Landmark, a designation which reflects the outstanding condition, rarity, diversity, and value to science and education of the natural resources on the land.

As our Irvine Open Space Preserve website explains, “Since its incorporation in 1971, Irvine has had a strong desire to balance the built and natural environment. As this incredible master-planned community has grown, each phase of development has been accompanied by the preservation and enhancement of natural open spaces, creating the network of parks, trails, and wildlands that residents and visitors may enjoy today and for generations to come.”

A crucial environmental issue facing Irvine in the near future is whether to switch from purchasing energy from SoCal Edison to utilizing a Community Choice Energy provider.

Community Choice Energy (CCE) is a program that brings local control and freedom of choice and competition into the electricity marketplace. Community Choice allows cities and counties to purchase power on behalf of their residents and businesses to provide cleaner power options at a competitive price.

It has been operating in California since 2002 following passage of Assembly Bill 117.

On September 25, 2018, the Irvine City Council approved conducting a feasibility study to determine the pros and cons of implementing a CCE program, including potential economic benefits for the community.

Community Choice programs enable local government control over energy procurement to purchase power, set competitive rates, and collect revenue. The local utility still maintains the electricity grid, deliver energy, and bill customers.

Community Choice Energy programs offer automatic enrollment to businesses and residences in its jurisdiction, with the ability for the customer to opt out and continue to purchase electricity from the utility. Customers have the option of choosing increased percentages of renewable energy.

CCE programs in California generally procure and resell a power mix between 50 percent and 100 percent renewable energy to their customers.

Community Choice Energy can be one of the most powerful ways to accelerate the transition from fossil to cleaner renewable energy.

Community Choice introduces competition and consumer choice into the electricity sector with a focus on local, renewable energy to stimulate rapid innovations in clean energy systems.

By the mid 2020s, as much as 85% of Californians will be served by a Community Choice Energy program.

When our feasibility study is completed, I hope Community Choice Energy will soon be available in Irvine and throughout Orange County.

At our best, the City of Irvine has striven to be simultaneously people-friendly, business-friendly, and earth-friendly.

We must continue to insist that each phase of our City’s development be informed by science, accompanied by careful planning, and prioritize the preservation and enhancement of our environment.

Visiting the California Firefighter Memorial: Honoring Those Who Gave All

I made a visit to the California Firefighter Memorial this afternoon and it deeply touched my heart.

Fire and firefighters are in the news today, as hundreds of brave firefighters risk their lives to battle the flames trying to consume the irreplaceable and magnificent Cathedral of Notre Dame in Paris.

These days, fire and firefighters are often in my thoughts, both as a member of the board of directors of the Orange County Fire Authority and as the mother of a 20-year-old who is studying firefighting at the University of Alaska, Fairbanks, and serves as an EMT and member of the Fairbanks North Star Borough HazMat Team.

In fact, fire and firefighters should be in all our thoughts, as California’s wild land fire season expands to year-round, and more and more Californians live on the very edge of extreme fire-danger zones.

The truth is, fires in California have become more frequent and more dangerous, and Californians have never relied more on well-trained, well-equipped, well-led and brave firefighters risking all to keep our lives and property safe.

The California Firefighters Memorial is located on the grounds of the California state capitol in Sacramento and honors the more than 1,300 California firefighters who have died in line of duty or of other duty-related illness or injury.

The California Fire Foundation, a 501(c)(3) non-profit organization created by California Professional Firefighters, raised the money to construct the Memorial and is responsible for its ongoing upkeep. Ongoing fundraising ensures the continued maintenance of the Memorial with no taxpayer dollars.

The California Firefighters Memorial was unveiled on April 6, 2002, carrying the names of 855 fallen California firefighters. Since the unveiling, more than 400 names have been added at annual Memorial ceremonies.

The Memorial has three components that work together seamlessly:

The Memorial Wall: A two-sided brushed limestone wall on which is inscribed the names of every firefighter who has died in the line of duty since California became a state. The wall is flanked by bronze statues of firefighter “turnouts” – the protective garments worn by firefighters in action

“Fallen Brother”: A bronze statue, directly adjacent to the wall, that honors our fallen heroes. It depicts an anguished firefighter removing a lifeless colleague from the flames. The statue was created by Jesus Romo, a retired Sacramento firefighter

“Holding the Line”: A bronze statue depicting four firefighters in action working a hose line. The statue was created by artist Lawrence Allen Noble.

I’m Attending the 2019 Housing California Conference as Chair of the Irvine Community Land Trust, Working with Experts, Legislators, and Community Advocates to find Practical Solutions to California’s Housing and Homelessness Crisis.

I’m in Sacramento for the next three days lobbying for housing and attending the 2019 Housing California Conference as Chair of the Irvine Community Land Trust.

Housing California is the “voice in the state Capitol for children, seniors, families, people experiencing homelessness,and everyone who needs a safe, stable, affordable place to call home.”

The vision of the Housing California is creating “a California in which no one is homeless and everyone can afford a safe, stable place to call home in a healthy and vibrant community.”

The Housing California Annual Conference started in 1979 with a small gathering across the street from the State Capitol, and has since grown into the largest and most diverse affordable housing and homelessness conference in the country.

The 2019 Housing California Conference focuses on the most crucial issues for housing in our state, including legislative, electoral, administrative, and budgetary policy strategy and solutions pertaining to affordable housing and homelessness; supportive housing, rapid re-housing, emergency responses, and bridge housing; affordable housing development including construction, design and entitlement, sustainable practices, and development innovations; affordable housing finance and asset management; and diversity, equity, and inclusion.

Housing is truly the issue of our time in California, and helping to create more affordable and attainable housing, especially for seniors, young families, veterans, and people with disabilities, has been an important focus of my career as a public official.

In 2018, I was elected to serve as Chair of the Irvine Community Land Trust, guiding its mission of providing secure, high-quality affordable housing for the benefit of income-eligible families.  

I am excited to learn and share ideas, and to work with experts, legislators, and community advocates to find practical solutions to California’s housing and homelessness crisis.

Orange County Veterans Deserve a Final Resting Place. The ARDA is the Only Site that has a Real Chance of Receiving the Necessary Funding. Let’s Get it Done!

I have been fighting for a veterans cemetery on the hallowed grounds of the former El Toro Marine Air Station for many years, beginning in 2013.

As I wrote to the Irvine City Council in early 2014:

“Orange County has a long and proud military tradition. Currently, more than two million veterans live in California – more than in any other state.  This military tradition continues into the present, as nearly 7,000 veterans of the Iraq and Afghanistan wars live in Orange County. Yet Orange County veterans do not have their own official military cemetery and those in Orange County who want to visit a veteran’s grave in a national cemetery must travel to Riverside, San Diego or Los Angeles counties.”

“It is time that Orange County offered its veterans – who have sacrificed so much for us – a final resting place close to their families and loved ones.  I believe that a portion of the Great Park in Irvine, which was once the El Toro Marine Corps Air Station, would be an altogether fitting and proper location for this Orange County Veterans Cemetery, as well as a lasting memorial to the Great Park’s military heritage.”

“As an Irvine resident and a member of the Irvine Community Services Commission – and as the daughter of an Orange County Korean War combat veteran – I urge you to create an Orange County Veterans Cemetery and, also, to locate this cemetery in a portion of the Great Park that was once the El Toro Marine Corps Air Station.”

On March 11, 2014, I cheered when the City Council unanimously voted to designate the Amended and Restated Development Agreement [ARDA] site in the Orange County Great Park in Irvine as the future site of a verterans cemetery.

But when I became an Irvine City Councilmember in 2016, I learned that there had been no progress on a veterans cemetery in the intervening two years because, I was informed, of the high cost of the decontamination and demolition necessary on the originally designated ARDA site.

Because the ARDA site did not appear to be financially viable, I, along with the Orange County Veteran’s Memorial Park Foundation and many national and local veterans organizations, supported the Strawberry Fields site as a less expensive, more practical, and faster alternative.

When the voters rejected the Strawberry Fields site as causing too much traffic and being too close to the freeway, I then proposed, along with Irvine City Councilmember Christina Shea, using a portion of the Orange County Great Park (and the former MCAS El Toro) that is currently planned for a golf course to be used instead for a veterans cemetery.

Subsequently, a site was proposed in Anaheim Hills near the 91 Freeway.  While I am not opposed to that site, the fact is that it has not received support from the Assembly, has not received any financial backing from either the county, state, or federal government, and is not located on the historically appropriate grounds of the former MCAS El Toro. It does not appear to be viable.

Now several of our state legislators have recently indicated a strong preference for the ARDA site originally designated by the Irvine City Council.

Assembly Bill 368, authored by Assemblymember Sharon Quirk-Silva (AD 65) and currently before the Assembly Veterans Affairs Committee, states that the California Department of Veterans Affairs “shall acquire, study, design, develop, construct, and equip a state-owned and state-operated Southern California Veterans Cemetery, which shall be located at the site of the former Marine Corps Air Station El Toro, on 125 acres known as the Amended and Restated Development Agreement [ARDA] Site in the Orange County Great Park in the City of Irvine.”

Significantly, several Orange County members of the legislature, from both sides of the aisle — Democrats Senator Thomas J. Umberg (SD 34) and Assemblymembers Sharon Quirk-Silva (AD 65) and Tom Daily (AD 69) and Republican Assemblymembers Tyler Diep (AD 72), William Brough (AD 73) and Philip Chen (AD 55) — have pledged to allocate the funds necessary for the decontamination of the site and the construction of a veterans cemetery in that location and urged the Irvine City City to re-designate it as the official site.

Their letter states, “Today, we are ready to work with State and Federal officials to secure funding for the Southern California Veterans Memorial Park and Cemetery.  We ask that you stand by your previous commitment to provide a resting place for California veterans at the ARDA site.”

In addition, Nick Berardino, President of VALOR (Veterans Alliance of Orange County) and a Marine Corps veteran of the Vietnam War, who has been advocating for a veterans cemetery for years, has responded to the legislators’ letter by saying “We are excited that the legislature is poised to support the veterans cemetery and impressed that the Orange County delegation is able to secure the funding in this years budget.”

This week, on April 9, 2019, Assembly Bill 368 was unanimously approved (10-0) for passage by the Assembly Veterans Affairs Committee and referred to the Appropriations Committee.

Accordingly, it is now clear that the only site that has a real chance of receiving the necessary funding for an Orange County veterans cemetery is the ARDA site.

For this reason, I am withdrawing my support for the golf course site option and joining with these state legislators in calling for the Irvine City Council to again designate the ARDA as the site for a veterans cemetery and calling on the state and federal government to provide the funding needed to build a veterans cemetery on the ARDA site in the Great Park on the hallowed grounds of the former El Toro Marine Station.

Further, this month, United States Representative Gilbert Cisneros (CA 39), a retired naval officer and a member of the Congressional Subcommittee on Military Construction, Veterans Affairs and Related Agencies has urged the federal government to step up and provide financial help for our long-overdue veterans cemetery in Orange County.

He wrote to the Subcommittee: “I urge you to provide increased funding for the Veterans State Cemetery Grant program in order to support a veterans cemetery in Orange County. With 3.19 million residents, Orange County has a disproportionately high population of veterans. However, it does not have a single veterans cemetery. Local veterans have been campaigning for a veterans cemetery for years, but the federal government has failed to rise to the occasion. While local entities are pursuing a state veterans cemetery, federal funding should be made available in order to get this project across the finish line. I urge you to increase the VA’s State Cemetery Grant program funding to ensure this long overdue project does not suffer any further delays.”

Along with the Orange County Veterans Memorial Park Foundation, which has led the fight years-long fight for an Orange County veterans cemetery, I say “Hurrah!” to Rep. Cisneros’ letter.

Based on all these factors, as a member of the Irvine City Council and the daughter of a combat veteran, I hereby fully commit to the goal of building a Southern California Veterans Cemetery on the grounds of the former MCAS El Toro at the ARDA site.

I have never approached this issue from a partisan perspective, or with concern for anything but properly honoring O.C. veterans like my father. My sole concern now — as it has been from the beginning of this effort — is doing whatever I can to ensure that an O.C. Veterans Cemetery becomes a reality.

I look forward to working in a positive, bipartisan way with our state and federal representatives, other Irvine City Councilmembers, the Orange County Veterans Memorial Park Foundation, veterans organizations, community groups, and private donors, doing whatever it takes and pulling together in the same direction, to finally establish the Orange County veterans cemetery that we have fought for and needed for so long.

Our veterans deserve a final resting place close to their families and loved ones.

Irvine Returns to the Orange County Fire Authority and I am Returning to the OCFA Board of Directors

I want to thank Irvine Mayor Christina Shea and my colleagues on the Irvine City Council for their decision to re-appoint me to the Board of Directors of the Orange County Fire Authority (OCFA).

For many years, there has been a dispute between the City of Irvine and OCFA over Irvine’s disproportionately large financial contribution to the fire service.

Because of these concerns, last June, the City of Irvine notified OCFA that it intended to withdraw from the agency in 2020.

In the months that followed, the City of Irvine and OCFA engaged in intensive negotiations with the purpose of finding a way to resolve our differences, particularly the disparity between Irvine’s financial contributions and the services we receive.

Happily, the result of these negotiations was an agreement under which Irvine will receive substantial benefits and considerations in returning to OCFA.

OCFA will contribute $20.5 million to a police-fire training facility in Irvine that will be utilized by the Irvine Police Department and OCFA to meet both separate and joint training needs.

Also, OCFA will establish a drone program as part of the agreement that allows monitoring of Irvine’s open space areas with the objective of quickly detecting, assessing, and preventing fires and other hazards.

Significantly, the agreement also includes a pension pay-down, under which OCFA will pay $2 million per year for a total of $22 million over 11 years into an irrevocable pension trust that can be used only for payment of employee pension liability. Approximately 58% of those funds will be earmarked to pay down any portion of OCFA’s unfunded pension liability that is attributed to Irvine.

UCI Housing Security Town Hall: Housing is the Issue of Our Time

In California, housing is the issue of our time.

I was grateful to be invited to speak recently at the recent Housing Security Town Hall sponsored by Associated Students at the University of California, Irvine.

Finding real and practical solutions to the housing and homelessness crisis has been a priority for me, both as a member of the Irvine City Council and as Chair of the Irvine Community Land Trust.

The problem of housing insecurity affects millions of Californians, impacting people of every age group and every background, hitting the most financially vulnerable first and hardest.

One of the groups most affected are students at our public colleges and universities.

The fact is that most students struggle financially with their housing during their time at UCI.  Some are even homeless.

According to a study done at UCI, 53% of students experience anxiety, depression, or severe stress due to housing insecurity, and minority students are more likely to face housing insecurity issues than non-minority students.

As the UCI student newspaper New University has reported, “Housing insecurity has been an increasing burden on UCI’s student population due to rising tuition prices and the growing Irvine housing market. Irvine Company, which owns several apartment complexes near campus as well as throughout the affluent city of Irvine, raises rent prices for students alongside prices for renters throughout the city. Housing insecurity has become such a problem that students are sometimes living in their cars because they are unable to find an affordable apartment.”

At the Town Hall, I spoke about what I’ve been doing to ensure more housing affordability in Irvine and throughout Orange County, including being the only member of the Irvine City Council to vote against the so-called boarding house ordinance — which would make illegal the living arrangements that are an economic necessity for most students and young people — and being the only member of the Irvine City Council to vote to allow incentives to build more permanently affordable housing.

It is time to recognize that the housing crisis will not get better unless we do what it takes to create more affordable housing.

All of us involved in housing — state and local elected officials, real estate developers, labor unions, financial institutions, and community groups — must find ways to work together to create the right legislative and economic environment for building the affordable housing that our state desperately needs.

City of Irvine Seeks New Member for Irvine Residents with Disabilities Advisory Board

The City of Irvine is accepting applications for one vacant position on the Irvine Residents with Disabilities Advisory Board.

The Irvine Residents with Disabilities Advisory Board was established in 1990 by the Irvine City Council to ensure residents with disabilities have equal access in community life.

The Board’s mission is identifying and recommending programs and services meeting the physical and social needs of residents who have disabilities, regardless of age.

The Board provides advocacy and support for programs related to community needs and propose recommendations to a variety of City departments.

Membership is not to exceed 14 voluntary members, with 51 percent of the board required to be a person with a disability or directly related to a person with a disability.

The Board is a public advisory body of the City of Irvine that reports to the Community Services Commission. Members provide input on the needs of Irvine residents with disabilities. The board is made up of volunteer members who live or work in Irvine.

Board members must participate in monthly meetings, which are held on the first Tuesday of each month at 6 p.m. at the Irvine Civic Center.

Applications are available at the Irvine Civic Center, 1 Civic Center Plaza. Applicants should visit the second floor Community Services Department front counter to obtain an application.

Join Me at the ASUCI Housing Security Town Hall on April 4 at UCI’s Crystal Cove Auditorium!

Please join me and leaders from the Associated Students of the University of California, Irvine (ASUCI) on Thursday, April 4, 2019, at 5:30 PM for the presentation of a groundbreaking report on student housing issues at UC Irvine.

Despite opposition from many community members and UCI student leaders, the Irvine City Council recently voted 4–1 to tighten restrictions on “boarding houses” and to ramp up code enforcement of housemate arrangements that are not the “functional equivalent of a family.”

As the UCI student newspaper New University has reported, “Housing insecurity has been an increasing burden on UCI’s student population due to rising tuition prices and the growing Irvine housing market. Irvine Company, which owns several apartment complexes near campus as well as throughout the affluent city of Irvine, raises rent prices for students alongside prices for renters throughout the city. Housing insecurity has become such a problem that students are sometimes living in their cars because they are unable to find an affordable apartment.”

As a member of the Irvine City Council, I voted against this proposed ordinance.  I believe that preserving neighborhood character is important, as is preventing excessive noise and improper home modifications. But these goals can best be achieved by enforcing regulations we already have on the books, not by prohibiting living arrangements that are financially necessary to students and young people.

I also have serious concerns about the constitutionality of the proposed ordinance, its intrusion into residents’ private lives, as well as its conflict with state law regarding housing.

Indeed, the California Department of Housing and Community Development contacted the City of Irvine immediately after the vote, expressing their concern that the ordinance violated state law.

As a result, the ordinance is being re-worked by City staff and will not move forward in its current form.

But those of us concerned about student housing insecurity and homelessness can’t let down our guard.

Sunday, March 30, is Earth Hour 2019

This Saturday, March 30, join millions of people around the world in switching off your lights and electronics from 8:30 – 9:30 p.m. for Earth Hour.

Starting as a symbolic lights out event in Sydney in 2007, Earth Hour is now the world’s largest grassroots movement for the environment, inspiring millions of people to take action for our planet and nature.

As a member of the Irvine City Council, I have been able to reinstate and vitalize the Irvine Green Ribbon Environmental Commission, which seeks to increase public participation in energy conservation and sustainable practices, helping the City serve the community through advancing environmental policy initiatives and programs.

I’ve also helped move the City toward adopting Community Choice Energy, which allows cities and counties to purchase power on behalf of their residents and businesses to provide cleaner power options at a competitive price.

In addition, I’ve helped to make Irvine a national leader in finding non-toxic solutions to weed and pest control, and finding effective, non-toxic and eco-friendly ways to maintain Irvine’s open spaces and reduce fire danger.

I’ve helped Irvine increase our iShuttle program by 50 percent, and worked to improve Irvine’s bike trails for recreation and commuting.

But we need to do more, and faster. Most importantly, we need to step up efforts to switch from using fossil fuels – the biggest cause of climate change – to clean, renewable energy.  And we need to help people and nature adapt to the inevitable changes ahead.

Climate change is perhaps the greatest challenge humanity has ever faced.  It affects every corner of our planet – from the poles to the tropics, and from the mountains to the oceans. People and nature worldwide are already feeling the effects: water supplies are shrinking, extreme weather events increasing in frequency and intensity, forests burning, and coral reefs dying.

All around the world, governments and communities are coming together to act –- and we can still escape the worst impacts of climate change, and build a safer future for all.

Irvine Releases Proposed 2019-2021 Budget. Tell Us What You Think!

The City of Irvine has released a proposed budget for FY 2019-2021.

I ran for City Council on a platform of using my skills as a business attorney to safeguard every public dollar, and I have kept that promise by making sure that Irvine is financially transparent and accountable, and doesn’t spend more than it can afford.

Government transparency and fiscal responsibility should be neither a conservative nor a liberal idea, but appeal to both, as we strive to address increasing social needs with limited resources.

I am proud to have received the Orange County Taxpayers Watchdog Award from Orange County Auditor-Controller Eric H. Woollery, along with Mayor Don Wagner and Councilmember Christina Shea.

I am proud that during my tenure on the Irvine City Council, Irvine has received numerous awards for fiscal responsibility and transparency. These awards reflect the commitment that I and my colleagues on the Irvine City Council have made to the taxpayers and residents of Irvine, and to the principles of government transparency and fiscal responsibility.

I am also proud that during my term in office, Irvine has adopted the Irvine Sunshine Ordinance that expands public notice to four times longer than California law requires, and has approved a two-year budget cycle, along with a five-year financial planning program. These changes make planning more transparent, give residents more opportunity for input into budget and planning, and make city government more accountable.

The City of Irvine has now released its proposed budget for Fiscal Year 2019-2021.

Prior to proposing a budget for FY 2019-2021, the City hosted four Community Budget Meetings in March. These meetings were the City’s first-ever attempt at both informing constituents about the state of its finances and seeking input on spending priorities before the budget proposal was finalized.

Strategic priorities addressed in the proposed budget include: maintaining high-quality essential City services, enhancing Citywide mobility through transportation improvements, promoting innovation through effective use of Information Technology solutions, and recruiting and retaining high-quality employees.

Next in the process, the budget will be presented to the Finance Commission in April 2019.  These meetings are open to the public and your continued input in the form of public comment is welcome.

Roger is a long-time corporate CFO/VP/Controller with a master’s degree in finance from Stanford University who cares deeply about ensuring both Irvine’s financial health and our quality of life.  He would love to hear from you about the proposed FY 2019-2012 budget. Following Finance Commission input, the proposed two-year budget and five-year plan will be presented to the City Council for approval in May.

Democracy Requires an Election to Fill the Vacancy on the Irvine City Council

When Irvine Mayor Donald Wagner took office as an Orange County Supervisor, Mayor Pro Tem Christina Shea automatically took his place as Mayor.

As a result, there is now a vacancy on the Irvine City Council.

Democracy requires an election rather than an appointment to fill this vacancy.

According to law, a vacancy on the Irvine City Council can be filled by appointment by the remaining four members of the Council or by election by the vote of all the residents of Irvine.

Even if the City Council appoints a new member, the people can still override that appointment and demand an election by filling a petition signed by seven percent of the voters of the City.

Some argue that precedent and financial concerns support appointing the third-place runner-up in the previous election to the open seat on the Irvine City Council, rather than holding an election in which the people will choose the person to serve as their representative.

In fact, neither precedent nor principle support an appointment over the people’s choice as determined by an election.

Since the incorporation of Irvine as a City in 1971, there have been three times that a vacancy needed to be filled for a councilmember.

In the first instance, on October 15, 1985, Ralph A. “Ray” Catalano, a professor at UCI and a former planning commissioner, was appointed to serve the remaining three years of Councilmember David Sills term when Sills resigned from the Council to become a superior court judge.

Significantly, Catalano was not the next highest vote-getter in the previous election.  Catalano was not even a candidate in that election and had never run for office. The person who was the next highest vote-getter in the previous election, Mary Ann Gaido, was not appointed to the open seat. Catalano later explained that he was a political compromise choice and was picked by Sills as his successor.

That is the only time that the Irvine City Council has used an appointment by Councilmembers rather than an election by the people to fill a vacancy on the Council.  In every other case of a vacancy on the City Council, the seat has been filled by a vote of the people in a special election.

Our very first Irvine City Council election was a special election, held on December 21, 1971, when Irvine residents approved the City charter.

On November 6. 1990, a special election was held to fill the vacancy on the City Council when Councilmember Sally Anne Sheridan was elected Mayor the previous June. The next highest vote-getter from the previous election – again it was Mary Ann Gaido – was not appointed.  Bill Vardoulis, who had not run in the prior election, entered that race and won that special election.

On November 3, 1992, a special election was held to fill the vacancy on the City Council when Councilmember Art Bloomer resigned with two years remaining in his term.  The next highest vote getter from the year of Bloomer’s election – and it was again Mary Ann Gaido — was not appointed. Greg Smith won that special election.

Additional special elections have also been called numerous other times for various reasons, such as voting on charter amendments, measures and ordinances.

In fact, in the history of municipal elections in Irvine, special elections seem to be the rule rather than the exception.

Third-place candidates have been elected to the City Council under Measure A, which was adopted by the voters in 1991.

Measure A provides in that in City Council elections where one of the sitting Councilmembers is running for Mayor, the voters can cast three ballots for candidates for the office of City Council, so that “if a council member whose term of office has not yet expired is elected to the office of Mayor, the vacancy in the office of that Councilmember shall be filled by the candidate for Councilmember receiving the third highest number of votes.”

So far, this situation has happened four times.

On June 7, 1988, third-place City Council candidate Cameron Cosgrove was elected when Larry Agran was elected Mayor.

On November 7, 2000, third-place City Council candidate Beth Krom was elected when Larry Agran was elected Mayor.

On November 2, 2004, third-place City Council candidate Sukhee Kang was elected when Beth Krom was elected Mayor.

On November 4, 2008, third-place City Council candidate Larry Agran was elected when Sukhee Kang was elected Mayor.

Our current situation is very different from those cases.

In those cases, the voters were given the explicit opportunity to vote for three candidates for City Council.

As a result, the third-place candidate gained his or her seat on the City Council directly and democratically through the knowing vote of the people, not by appointment based on coming in third when the voters only had the choice of two.

Indeed, as I have shown, our City has NEVER appointed a Councilmember based on a third-place or next-highest finish in a previous election.

Some have argued that we should use this method of appointment – which we’ve never used before – simply in order to save the money that would need to be spent on an election.

First, it should be noted that other local cities are conducting special elections for councilmembers that could easily be coordinated by the Orange County Registrar with our own, thereby reducing the cost of the election.

Most importantly, however, I believe that democracy is worth the cost.

Democracy is far from perfect.

Many of us are convinced that we could pick better officials than those the people elect.

But that is not what our nation is about.

We elect our officials as our representatives; they are not appointed over us.

Democracy is messy, inefficient, and, yes, sometimes expensive.

In the words of Winston Churchill, “democracy is the worst form of Government except for all those other forms that have been tried from time to time.”

I agree.

We should fill the vacant seat on the City Council with the choice of the people as determined by an election.

UPDATE:

On Wednesday, April 3, 2019, the Irvine City Council officially declared a vacancy on the Council.

I have been informed by the city’s attorney and the city manager this declaration “starts the clock” regarding the process of filling the vacant council seat. We now have 60 days from April 3, 2019, to come to an agreement on the appointment of a new Councilmember or there will be an election.

Residents have 30 days from April 3, 2019, to file a petition signed by seven percent of Irvine’s registered voters to require an election regardless of what the council does.

UPDATE:

There is now a Republican proposal to circumvent this voting process by using an arbitrary ‘point proposal,’ under which “each Councilmember shall list three (3) applicants [candidates] in order of preference.” The candidates will be assigned the following point values: Top candidate 3 points, second candidate 2 points, and third candidate, 1 point.

Under this proposed procedure, the applicant receiving the most points will be appointed.

This proposed “point ” procedure:

(1) has never been used by the Irvine City Council to decide how to fill a council vacancy or to make any other appointment;
(2) violates the most crucial principle of a representative democracy — that the people’s representatives are selected by majority rule.

Arbitrarily assigning points to 1st, 2nd, and 3rd choice applicants, and then saying the applicant with the “most points” wins, is simply a way to avoid majority rule. It undermines the basic legitimacy of Irvine’s government.

Please attend the next Irvine City Council meeting on Tuesday, April 9, at approximately 3:00 p.m. to make sure your voices are heard.

UPDATE:

While the so-called “point” procedure was defeated at the last meeting, the question of whether to appoint or have an election is still not settled.

Please attend the next Irvine City Council meeting on Tuesday, April 23, where the Council will likely decide either on a process for appointment of the 5th council member to the vacant seat or deadlock to cause an election.

Closed session starts at 4:00 p.m. and the open meeting begins at 5:00 p.m. The agenda is packed so this may run late.

Irvine Posts New Web Page Detailing the City’s Efforts to Combat Homelessness

The City of Irvine has posted a new web page detailing the City’s efforts to combat homelessness.

As a member of the Irvine City Council, I’m proud of what we’ve done.

I’m especially proud of our inclusionary housing requirement that 15 percent of all new residential development be affordable to lower-income households.

I’m also proud of the City of Irvine’s establishment and funding of the Irvine Community Land Trust, which I am honored to serve as Chair, dedicated to creating affordable housing.

In 2018, we opened Parc Derian, which brings 80 new units of housing for working families, veterans, and special-needs residents of Irvine. Located in the Irvine Business Complex, Parc Derian is a beautiful multifamily community with a pool, tot lot, private parking, exercise center, computer lab, and onsite resident services.

Also in 2018, we began work on Salerno, a new 80-unit rental community. Like Parc Derian, Salerno will provide permanent affordable housing for working families, veterans, and special-needs residents of Irvine.

Significantly, in 2018 we began to develop our first homes for ownership with help from a new partnership with Habitat for Humanity of Orange County. This new Irvine community, called Chelsea on Native Spring, located north of Irvine Boulevard, will include 68 affordable home for sale to income-eligible veterans, working families, and young professionals.

Homes will be sold to first-time homebuyers who earn up to 120 percent of the area’s medium income. In an area where the median home price is $727,000 and average annual income is around $80,000 for a family of four, many people are priced out of the market and face housing and financial uncertainties while trying to build a life in Irvine. The Chelsea on Native Spring project aims to keep those people in Irvine, especially military veterans, teachers, nurses, and young professionals.  It is expected to begin construction in 2019.

In addition to these new projects, we continued in 2018 to provide quality housing and services to 238 households living at Alegre Apartments and Doria Apartment Homes.

In all, that’s 466 households, and more than a thousand people, who can comfortably live, work and raise families in Irvine directly because of the work of the Irvine Community Land Trust.

In fact, over the past 30 years, Irvine has developed more affordable housing for families and individuals at risk of homelessness than any other city in Orange County.

Irvine has also provided over $6.7 million in grant funding to nonprofit organizations for homelessness prevention programs.

I am proud too of our Irvine Police Department’s approach to homelessness, which employs a dedicated team of Mental Health and Homeless Liaison Officers and is characterized by compassion and concern for those suffering from economic hardship, mental illness, and addiction.

The City has established a dedicated email address, outreach@cityofirvine.org, to address homelessness in Irvine. If you know someone in need of services, or if you have a question related to homelessness in Irvine, please contact us.

Irvine has also partnered with several non-profit community organizations — including Families Forward, Second Harvest Food Bank, FOR FAMILIES, Human Options, Second Chance OC, South County Outreach and StandUp for Kids — to help people experiencing housing insecurity or homelessness.

Of course, more needs to be done to resolve the homelessness crisis and alleviate the human suffering we see around us throughout Orange County.

While I’m proud of all we’ve done in Irvine, I’m also dedicated to doing more.

I’ve traveled to Sacramento to convince our legislators to reform the tax code to make it easier to build affordable housing.

I’ve traveled to San Antonio, Texas, and Pittsburgh, Pennsylvania, to see possible solutions in action.

We need more affordable housing and more attainable housing.

We need more mental health services.

We need real regulation and supervision of so-called sober living homes that heartlessly dump untreated addicts into our communities when their money runs out.

No area of the nation has been more adversely impacted by these unregulated and profiteering sober living homes than Orange County.

We need to work with responsible non-profit community and faith organizations to find real solutions to the growing crisis of drug and alcohol abuse.

Homelessness is a both humanitarian crisis and a public health crisis that we can not ignore or simply pretend to legislate out-of-existence. Helping our homeless population will require a concerned, regional, and state-funded approach that both provides safe temporary shelter and effective, humane solutions of the root causes of homelessness.

Let’s working together to achieve these goals and truly resolve the homelessness crisis.

Irvine Community Land Trust Seeks Two New Volunteer Board Members to Help Us Create Affordable Housing!

As Chair of the Irvine Community Land Trust (ICLT), I am pleased to announce that the Land Trust is seeking two new volunteer board members who are passionate about helping us create affordable housing!

In order to expand and diversify the skillset of the Board, the ICLT is specifically looking for experts in either accounting and finance, fundraising, information technology or public relations and marketing. These traits are critical to the organization’s future plans as it executes on its mission to bring 5,000 affordable homes to the City of Irvine.

A non-profit organization, the ICLT efficiently addresses a dire need in the city of Irvine with significantly less impact on taxpayers. Since 2006, the ICLT has created more than 325 permanently affordable homes, with an additional 80 apartments and 68 townhomes in the pipeline.

In addition to the Accounting, Fundraising, PR/marketing and/or IT backgrounds, the ideal candidate should:

  • Live and/or work in the City of Irvine.
  • Be available to meet once a month with the full board. Usually those meetings are the third Monday of each month from 4 to 6 p.m.
  • Be available to contribute additional time for subcommittee meetings several times a year.

Candidates will be interviewed by a subcommittee; finalists may be interviewed during an upcoming board meeting. Successful candidates elected to the board will serve a two-year term.

About the Irvine Community Land Trust

The Irvine Community Land Trust was created by the City of Irvine to provide secure, high-quality affordable housing through the operation of a non-profit community land trust, securing and retaining title to land on which permanently affordable rental, ownership and special needs housing will be constructed and maintained for the benefit of income-eligible families.

In 2017, the Land Trust became an independent agency, allowing greater operational efficiency while maintaining public involvement through its partnership with the City.

The vision of the ICLT is that by the year 2025, the ICLT will have created approximately 5,000 units of permanently affordable housing in the City of Irvine, contributing more than 50 percent of the City’s 2025 goal of 9,700 affordable units. In addition, the ICLT will conduct a monitoring program and provide stewardship for these units, insuring high-quality construction, design, sustainability, maintenance and permanent affordability. ICLT will achieve self-sufficiency by ensuring that fees and other earned income are sufficient to support the organization’s ongoing operating costs.

The City of Irvine’s Budget Will Not Include Cuts to Irvine Schools

Recently, City of Irvine staff proposed that, due to a projected budget shortfall, the City should consider cutting its support for Irvine’s public schools and reduce its spending on public safety.

I strongly opposed these cuts.

While I am concerned about the City’s fiscal health and our budget — a topic I will address soon in a future blog post — I do not believe that it is in the best interests of Irvine’s residents to curtail our support for education and public safety.

Due to my opposition and that of other City Council Members, as well as conversations between myself and Irvine Unified School District Board Members, and IUSD and City staff, reductions to school funding will no longer be proposed for the upcoming City budget.

Here is the official announcement:

“A special message about the City of Irvine’s $80 million in cash grants and program support for Irvine schools since 2008.

The City of Irvine has proudly provided cash grants to benefit Irvine schools and students for 13 years. The City uses vehicles such as the Educational Partnership Fund (EPF) program, established in 2006, and the Challenge Match Grant Program, created in 2008, to facilitate support.

From 2006 through June 2019, the City has provided $32 million in direct cash grants benefiting Irvine schools. The City is continuing to commit another $4 million annually for the next two fiscal years, for a total cash contribution of $40 million to benefit Irvine schools.

Beyond cash support, the City provides over $10 million annually in direct and indirect services to Irvine schools and students. The City of Irvine has provided over $80 million in direct and indirect support benefiting Irvine schools since 2008.

Indirect programs include school resource officers at middle and high schools; D.A.R.E. instruction so that elementary school students refrain from drug use and bullying and practice responsible internet use; crossing guards; middle school and high school youth action teams; and joint field and pool use. The two Partnership for Educational Excellence Programs grew from $1.5 million per year to $4 million per year in direct cash grants. The City Council established this funding because schools are a priority; voters affirmed it, and the Irvine City Council continued this unique funding tradition after the voter measures expired in 2016.

The City remains committed to supporting Irvine schools. The City is also committed to its long-term financial planning, transitioning to a two-year budget and a five-year financial plan. The City’s financial condition shows a structural deficit. The executive management team values transparent discussions early in the budget planning cycle. This includes open dialogue at community meetings, in order to facilitate a proposed balanced budget that meets many needs. City executive management proposed a host of changes and reductions to address the shortfall, including a possible reduction to some of the $10 million in annual support to Irvine schools in order to ensure adequate City and Police services.

While reductions to school funding will no longer be proposed for the upcoming budget, we need to work together to find constructive approaches. The City faces leaner times. We want to ensure our support for Public Safety, which is a top priority for the Council and the community, is not jeopardized. Mutual cooperation and productive communication is critical for effective long-term financial planning that balances community priorities and the City’s budget.”

Irvine History Happy Hour: The Portola Expedition

You are invited to join the Irvine Historical Society on Sunday, March 24, from 3:00 p.m. – 5:00 p.m. for an engaging and fun “Let’s Talk History” Happy Hour.

The topic this month is Gaspar de Portola and the Year 1769.

Did you know that the Portola expedition was motivated in part by expelling the Jesuits from Alta California and replacing them with Franciscans?

Did you know that of the original 219 men of the Portola expedition who left Baja California for the north on three ships, only about 100 survived to begin their journey from San Diego to Monterey?

Did you know that the Santa Ana River was originally called Río de los Temblores because Portola and his expedition experienced an earthquake while they were camped there?

Did you know that the Portola expedition arrived in what is now Irvine on July 26, 1769?

Did you know that we have fairly detailed information about the expedition because Portola and Father Juan Crespi kept diaries of the journey, and the expedition’s engineer, Miguel Constanso, later wrote up an official narrative of the trek?

You can learn more fascinating details about Gaspar de Portola, Father Junípero Serra, and their expedition, at the Irvine History Happy Hour on March 24.

Light refreshments will be served. A $5 donation is requested.

The Irvine Historical Society is located in the San Joaquin Ranch House, commissioned by James Irvine in 1868 and considered the oldest standing structure within the original boundaries of Irvine Ranch.

Standard hours of operation are Tuesday and Sunday from 1 to 4; closed holidays. Members are free; a $1.00 donation per non-member is appreciated.

One-hour walking tours of Old Town Irvine are available on the first Sunday of each month at 11:30 a.m. Free for members; $5 for non-members.
